September trial to proceed with city, ARPA By Steve Block, Staff writer, TTi • June 21, 2013 Trinidad’s city council passed a motion at Tuesday’s meeting, after meeting in executive session, rejecting a stipulation that could have delayed the upcoming trial in the city’s lawsuit against the Arkansas River Power Authority (ARPA), which is scheduled for September in Las Animas County’s Third District Court. Council moved to accept a second stipulation, this one resulting from ARPA’s lawsuit against Trinidad. The second stipulation allows for an outright settlement of ARPA’s litigation claims against Trinidad (with prejudice), according to a Wednesday city press release. ARPA battle continues with the city The legal tangle between the City of Trinidad and the Arkansas River Power Authority (ARPA) continued to grind its way forward Friday as the two litigants faced each other in a status conference in Third District Court, before District Court Judge Leslie Gerbracht. The most tangible result of the status conference, which was conducted mainly via teleconference between lawyers representing the two sides, was to establish a joint hearing date for the contending lawsuits in Trinidad at 9 a.m. on July 9, 2013. The city filed a lawsuit against ARPA in March 2011, seeking to extricate itself from the six-member power authority. The city based its lawsuit on concerns over the troubled coal-fired, fluidized-bed power plant built by the Lamar Repowering Project (LRP). The plant turned out to much more expensive than planned, and ARPA’s member communities, which include Holly, Las Animas, La Junta, Lamar, Springfield and Trinidad, are saddled with $170 in bond indebtedness.
