As part of its mission to guard against terrorist attack, the government does engage in a number of data collection programs. Certain of these programs were challenged in two U.S. courts, resulting in conflicting rulings by the judges. Due to these contradictory rulings, I believe the issue will now go before the U.S. Supreme Court for resolution. Meantime, an independent panel commissioned by President Obama recently released a report with recommendations for increasing transparency and accountability. The president is reviewing the recommendations and will consult with Congress on possible reforms. I will keep your thoughts in mind when considering such. There is a valid and constitutional argument to be made that the president may refrain from defending and enforcing laws that he believes are palpably and demonstrably unconstitutional. These arguments go back to Thomas Jefferson, who refused to defend or enforce the Alien and Sedition Acts because, by punishing speech, they directly contradicted the First Amendment. Jefferson argued that when a law contradicts the Constitution, the law must give way because the Constitution is the supreme law of the land and all other laws are inferior and must conform to it.This argument is itself now universally accepted jurisprudence -- except by President Obama, who recently and inexplicably questioned the jurisdiction of the Supreme Court to invalidate the Affordable Health Care Act on the basis that it is unconstitutional.

Supreme Court Justices voiced skepticism Monday regarding President Obama's recess appointment powers, in the first such case to be considered by the high court. "THE SENATE IS IN RECESS BECAUSE I SAY IT IS" . . . according to the president with the most transparent administration EVER. The court heard arguments Monday in a politically charged dispute over the president's power to temporarily fill top-level posts when the Senate is in recess. President Obama ran for office on affordable health care for all. He got elected. Our congress created legislation that does this, called The Affordable Care Act. It passed both house and senate and the president signed the bill into law. The AMA and the Insurance industry backed this legislation. President Obama ran for re-election against Mitt Romney who promised to kill the ACA on "day one". President Obama got re-elected. The Affordable Care Act was ruled constitutional by the very conservative Supreme Court. Trying to change settled law by staging a government shut-down is not the way to change settled law. President Obama's explanation for the GOP's actions: President Obama did something big in this statement. He revealed the real Republican motivation for shutting down the government. Republicans are angry that they lost the election in 2012. They are angry that the Supreme Court ruled the ACA to be constitutional. They are angry that Barack Obama is still the president. In this day of celebration, the LGBT community needs to keep in mind that this battle was won with the support of many of our straight brothers and sisters in our various communities including lawyers Ted Olson and David Boies who led the Prop 8 fight all the up to the Supreme Court. It's time to get rid of the filibuster once and for all. It has enabled the Republicans to block progressive legislation and to prevent the confirmation of President Obama's nominees. Ironically, when Bush was president and nominated terrible judges to the Federal Courts, the Democrats tried to filibuster the confirmation of those judges (such as Janice Brown, a terrible justice of the California Supreme Court to the Federal Court of Appeals for the DC Circuit). The Republicans threatened to change the Senate rules via the "nuclear option" so as to forbid any filibustering of the confirmation of federal judges. My nightmare scenario: President Obama wins the Electoral College vote, but loses the popular vote. The GOP appeals to the U.S. Supreme Court, which declares the Electoral College system unconstitutional (or Antonin Scalia comes up with some other lame reason to overturn the election, the way he got his colleagues to ignore the first 13 words of the Second Amendment).
