PIL filed in SC seeking dual citizenship for NRIs A Public Interest Litigation (PIL) seeking dual citizenship for overseas Indians was filed in the Supreme Court on Tuesday to mark the 100th anniversary of Mahatma Gandhi's return to India from South Africa. The over 25-million-strong Indian Diaspora comprises Non-Resident Indians (NRIs) and People of Indian Origin (PIOs) living in 192 countries across the globe. While the NRIs retain their Indian passports and enjoy most of the rights that resident Indians enjoy, the PIOs do not enjoy such rights because they have acquired citizenship of the countries they live in. Poll code won't hamper Jammu and Kashmir relief work: SC New Delhi: The Election Commission on Friday told the Supreme Court that it has already issued a communication to the Central Government and the Jammu and Kashmir government that the election code of conduct will not come in the way in the relief and rehabilitation of the flood-devastated people of the state. The Election Commission said this to an apex court bench headed by Chief Justice HL Dattu which had asked it to state whether the enforcement of code of conduct came in the way of the relief and rehabilitation work.

SC upholds 10-year RI despite 20-day delay in FIR New Delhi, October 22 The Supreme Court has upheld the 10-year rigorous imprisonment handed out to two convicts for gangraping a 15-year-old girl in Jagan village in Haryana’s Hisar district despite the fact that the victim had reported the incident after a delay of 20 days. The crime had taken place in May 1995 and the trial court delivered the verdict in December 1996, convicting and sentencing the accused – Kartar Singh and Om Prakash. The Punjab and Haryana High Court had dismissed their appeal in July 2008, prompting them to come in appeal to the SC. According to the police, the victim was alone at home as her family members had gone for the cremation of her grandmother in a neighbouring village. Cabinet defers decision on bill to scrap collegium system New Delhi: A decision on a Law Ministry proposal to bring Constitutional Amendment bill to scrap the collegium system of appointment of judges was deferred by the Union Cabinet on Wednesday. The bill came up for discussion but it was felt that more confabulations were required on the issue, sources said. According to the proposal, National Judicial Appointments Commission Bill, 2014 to amend the constitution to make way for the proposed body to be headed by the Chief Justice of India will be moved in Parliament. New Delhi, May 13 2014: Transgenders on Tuesday moved closer to getting reservation in employment and education in public sector with the National Commission for Backward Classes (NCBC) recommending their inclusion in the central list of the OBCs. The NCBC’s decision comes against the backdrop of a Supreme Court Order, which has directed the Centre and state Governments to treat the transgenders as socially and educationally backward classes to extend reservation in admission in educational institutions and for public appointments. The matter will now go to the Union Cabinet which will be required to approve the recommendation to enable the ‘Third Gender’ to avail of the benefits. “The Commission today unanimously passed a resolution to accept the verdict of the Supreme Court and decided to recommend to the Centre to include transgenders in the OBC list. New Delhi: The Supreme Court on Thursday refused to pass interim order on a plea challenging the policy for deciding the merit list of students for admission in government-funded engineering colleges based on 12th board marks and Joint Entrance Exam(JEE). A bench of justices H L Dattu and Dipak Misra, however, agreed to hear the plea of parents of engineering aspirants, who challenged the new "normalisation" policy. The bench said that it would hear the petition on merit only after being satisfied that the education policy violates Fundamental Rights of students. From this year students are to be selected based on their performance in the JEE and the marks they got in the Class 12 board exams. 60 percent weightage would be given to marks obtained in JEE and 40 percent to the board exam results. SC to decide on mercy plea of Rajiv Gandhi's assassins today New Delhi: The Supreme Court will on Tuesday deliver its judgement on the mercy petition by former Prime Minister Rajiv Gandhi's assassins. They are seeking to commute their death sentence on grounds of delay in deciding their mercy plea. The judgement will be delivered by a bench headed by Chief Justice P Sathasivam, which had reserved its verdict on the plea of three convicts - Santhan, Murugan and Perarivalan - on February 4. The convicts were given the death penalty in 2000 and their mercy petition was rejected by former President Pratibha Patil in 2011. Their plea was opposed by the Centre, which said that it was not a fit case to commute the death sentence. Former Attorney General G Vahanvati had argued that the convicts were leading full lives in jail without feeling any remorse. Abdul Kalam Wednesday had to wait for at least an hour to cast his vote, thanks to a faulty Electronic Voting Machine (EVM). According to a source, the former president waited for his turn to cast the vote at the K. Kamraj Marg polling station in New Delhi constituency when it was detected that the EVM had some glitch. "He (Kalam) had to wait for an hour before he got to cast his vote. As it was a long wait, he went back (home) and returned once the EVM was replaced," the official told IANS. Apart from the renowned nuclear scientist, many Supreme Court judges and the army and navy chiefs cast their votes at the polling station. 63 % RESCUED KIDS LESS THAN 14 : GOVT New Delhi: Of the 3,734 children rescued from different districts of Delhi between July 2009 and June 2013, a total of 2,357 (63%) were less than 14 years old, the state government’s records show, pointing to the severe exploitation of younger children as cheap labour. Delhi Commission for Protection of Child Rights shared the data at a meeting called to discuss the experience of implementing Delhi Plan of Action for Abolition of Child Labour with other state commissions last month. The city’s district task forces have carried out 1,450 rescues since the judgment of the Delhi High Court in 2009. Rajendra Dhar from the Labour Department said that Rs 1.18 crore has been recovered from employers for rehabilitation of the rescued children and more than Rs 35 lakh has been recovered as arrears of minimum wages. First commutation of death sentence by Pranab Atbir Singh, lodged in Tihar Jail, New Delhi, is the first death-row convict whose sentence has been commuted to life imprisonment by President Pranab Mukherjee. Mr. Mukherjee passed the order on November 15. Atbir is one of the 16 death-row convicts whose mercy petition, Pratibha Patil, Mr. Mukherjee’s predecessor, left undecided while completing her tenure. Atbir was convicted and sentenced to death by a sessions court in 2004 for the murder of his step mother, step sister and step brother in 1996 over a property dispute. New Delhi: India has failed to implement the concrete recommendations made by a UN Human Rights mechanism, enacting only 67 out of its 168 recommendations, which paints a grim picture of Human Rights in the country, a prominent rights activist said Friday. "Most of the concrete recommendations of the UPR have been rejected by the the government and it has only accepted the generic ones," Working Group on Human Rights (WGHR) convenor Miloon Kothari said at a press conference here. The Universal Periodic Review (UPR) is a mechanism established by the Human Rights Council (HRC), which aims to improve the Human Rights situation on the ground in each of the 193 UN member states and address Human Rights violations wherever they occur. New Delhi: The Supreme Court has slammed the government on Friday for failing to curb sexual harassment of women and said undercover female police should be stationed in public places. The top court urged action to stop what is commonly known in India as eve-teasing, which refers to a wide variety of harassment such as molestation or flashing. "We notice that there is no uniform law in this country to curb Eve-teasing effectively," judges KS Radhakrishnan and Dipak Misra said. The court directed the state governments to put female police officers in all public spaces including markets, parks, beaches and public transport. It warned that if no steps were taken to combat the problem the consequences could be "disastrous". New Delhi: An accused, evading the law and declared a proclaimed offender, cannot be accorded the benefit of anticipatory bail, the Delhi High Court has ruled. "Normally, when the accused is 'absconding' and has been declared a 'proclaimed offender', there is no question of granting anticipatory bail," said Justice Manmohan. The court, citing various Supreme Court judgements, said such a relief cannot be not given to an absconding accused who has been avoiding arrest and has been declared a proclaimed offender under the Criminal Procedure Code. BJP-YEDDYURAPPA BJP to wait for CBI report on Yeddyurappa before taking a call New Delhi, May 11 (PTI) Former Karnataka Chief Minister B S Yeddyurappa's wait to be reinstated was prolonged further today with the BJP indicating it will bide its time till the completion of CBI enquiry ordered against him by the Supreme Court before taking any step. Asked if Yeddyurappa's reinstatement as Chief Minister will now be difficult before the CBI submits its probe report on August 3, BJP spokesperson Shahnawaz Hussain said, "We respect the court judgement. We want an impartial enquiry. We want the truth to come out." The Supreme Court directed a CBI probe against him for allegedly granting undue favours to firms involved in illegal mining in lieu of donations to a charitable trust run by his kin. A Special Forest bench headed by Chief Justice S H Kapadia directed the probe agency to carry out the probe and file its report by August 3.
