For those who believe that the Supreme Court's Prop 8 decision is partisan and an abuse of power in defiance of the people's will, take note. What the Supreme Court Decided: In a 5-to-4 decision announced today, the Supreme Court held that the formula used in Section 4 of the Voting Rights Act to determine which states must receive preclearance for voting law changes was unconstitutional. With this decision, the Court effectively turns back the clock and erases the voting protections guaranteed in the Constitution. Why this matters: There is no more fundamental right we have as Americans than the right to vote. I am watching Lt. Governor Gavin Newsome speak. I think back to many years ago when Chief Justice John Roberts was being questioned by US Senator Diane Feinstein before he became Chief Justice. Diane put him through a polite but tough cross examination for some hours. At the end of the process she more less said this "Judge Roberts you're a very nice man. I'm going to vote for you." Diane was right. Chief Justice Roberts has been very conservative in many rulings. He has also shown a very warm, human and even kind side on some rulings like Obamacare. Now the ever-busy U.S. Supreme Court announces that it may "revisit" or "review" the Civil Rights Act of 1964. Chief Justice Roberts says he questions whether there is even any need for Section 5, since "voter suppression" seems to be a thing of the past. Is he crazy? Does he live in a solipsistic "alternate universe"? Does he read the daily newspapers? He hasn't noticed a systematic and nationwide effort to suppress the vote by any and all means? Is he living in a bubble, fed by ozone and helium? I'm sure that Alito, Scalia, and Thomas, with their 1920's views, agree with Roberts. Many conservatives are criticizing Chief Justice Roberts ruling on ACA of 2010. They are losing faith in the Supreme Court and other American institutions. How can America allow a coercive tax? They thought we had a system in place to protect us from government overreach. Surely Congress, the Presidency, the States, or the Judiciary would set things right. After reading ruling and thinking about it for a few days. I realized that Justice Roberts had it right. Despite the uproar by conservatives blasting Chief Justice Roberts for his decision on Obamacare I believe that he deliberately found a way to insure Obama's defeat in November. Roberts has the reputation of being a brilliant constitutional scholar and in fact wrote the first 3/4 of the dissent before writing the entirety of the majority opinion. By all accounts the majority opinion is filled with bad law and if written in a lower court would be overthrown. This opinion is certain to inflame voters from now to election day when the true magnitude of the increase in taxes becomes clear to the public. While the Supreme Court is supposed to be apolitical, I think Justice Roberts sees Obama as a threat to the Coiurt and saw this as his only recourse.

A bit late on commenting on the Supreme Court's decision on the Health Care issue but, I am quite surprised at Chief Justice Roberts at siding with the liberal judges. Such an awesome ruling, and weird turn of events!

Today is a great day! Thank you, Teddy Kennedy and others for all of your years of promoting Universal Health Care in the US. And thank you, Chief Justice Roberts, for finally making a decision to show that you do not head the most partisan Supreme Court in recent history. Thanks to Barack and others for creating this plan (using much of Mitt's MA plan) and to Nancy Pelosi for pushing it through the House. (Just shows what a determined woman can do!) Okay. So after fully soaking in the bit-by-bit coverage of the Supreme Court's ruling I feel I can finally feel like I can reflect on and say it was a pleasant surprise. Chief Justice Roberts, rather than Justice Kennedy was the swing-voter, for one surprise, and the individual mandate being seen as constitutional as a tax was another. Lets tout this as a big win for President Obama.
what really irked me was who cast the deciding vkie in the Supreme Court today. It wasn"t Justice Kennedy like I thought, but it wasa Chief Justice Roberts. O.K., since the Supreme Court didn"t do it, we"ll have to do it at the ballot boe this November by voting out the Senate Democrats and Obama, too.

For whatever they are worth these are my observations of the US Supreme Court decision upholding OBAMACARE. Yes, I am proud to call it OBAMACARE. The Affordable Health Act was developed by President Obama. It is a HIS piece of legislation to make sure that ALL Americans will have Health Care protection. I applaud Chief Justice Roberts for not only understanding and supporting what the President had enacted but for going the extra yard to find a way to support it under the US Constitution. My feeling is that Justice Roberts could be evolving into another Earl Warren who was also appointed by a Republican President and became one of the major proponents for protecting all Americans. This one time the Supreme Court got it right! Kudos for Chief Justice Roberts!!! If you are a major health insurance provider or own stock in that "business" maybe you should shed a tear, but if you are one of the millions of Americans who have had to choose between eating and having Health Care, or depended on visits to the Emergency Department for you Health Care, this is a great day. We, all of us with Health Care policies can benefit from this as we no longer have to subsidize those without Health Care by paying ever rising Health Care premium costs! Small businesses will be able to afford Health Care for their employees because they will now have the same buying power that major corporations enjoy in purchasing power. So the Supreme Court upheld Obamacare today. Now before the misinformed begin to cheer, understand that Chief Justice John Roberts, a conservative, was the deciding vote. Justice Roberts said in his dissertation that the penalty for non participation is indeed a tax (the Republican's argument) but taxes are legal. Before you condemn him if you were against Obamacare, realize that in his closing statements, Justice Roberts said that elections and thier outcomes indeed matter. That was basically saying that the law *** and if you don't like it, vote for Romney to get it repealed. I firmly believe Chief Justice Roberts just handed the Presidency to Mitt Romney. Right after the Supreme Court hearings on Obamacare were done, Mark Levin speculated that Chief Justice Roberts might opt to join the Libs on the court and uphold Obamacare with the intention of writing the majority opinion in which he would attempt to limit the scope of Congress' power to regulate commerce. That's exactly what happened. I'm not sure if Mark Levin came up with the prediction himself, but I find it pretty amazing. That guy is sharp.
The surprising thing about today's Supreme Court decision was that the swing vote wasn't Justice Kennedy. It was Chief Justice Roberts. I appreciate the fact that he put legal fact above partisan politics and did his job. I doubt it was easy for him.

I am so HAPPY the Affordable Health Care Act was upheld by our Supreme Court. I admire the integrity of Chief Justice Roberts. Working in the Health Care profession for many years I have seen the devastating effects of the current system - people not covered because of preexisting conditions, so many without coverage, persons using the Emergency Department for minor illnesses. Hurray for Obamacare!
This morning I said "Pilasters of confidence just eroded under the Supreme Court credibility foundation in the eyes of the American People.." I jumped the gun a bit, when Chief Justice Roberts became the un-catalyst in the ruling of a mandate with the hallmarks of a “regulatory penalty", not a tax. I am clearly one of the millions of dissenters who will join Romney to defeat in November President Obama, along with this mandate. But it dawned on me a little later, that Mr. Obama, was thrown a curve-ball, or a slider if you will, and although has not reached his base yet, all the loose ends of the GOP are coming to a perch pole and not necessarily to roost, but to actuate a change that the majority of American firmly believes. Wow! I am indescribably proud of our President! I just watched his remarks for the East Room of the White House. Not only did he give a powerful defense of PPACA, he displayed the political wisdom to stay largely out of the fray until the period was placed at the end of the sentence. I must also applaud Chief Justice Roberts. As I said for months,. the Supreme Court would have had to manufacture a reason to overturn the law and he alone among his conservative colleagues refused to do so. Well-done, sir. It's a beautiful day.

Pssst. The Individual Mandate has just survived the much anticipated Supreme Court ruling - with Chief Justice Roberts writing the majority opinion. The vote was 5 - 4. This is a big loss for Republicans in one sense - but in another, Congressional Republicans are now off the hook to come up with a replacement to "Obamacare", which they are too emotionally and socially retarded to even attempt.
Although no one knows how the Supreme Court will rule, Thursday, on ObamaCare, journalists over the past few months have dismissed and derided the concept that the President's signature legislation could be declared unconstitutional. CNN's Jeffrey Toobin predicted an eight-to-one vote upholding the law. Former New York Times Court reporter Linda Greenhouse said that Americans who think the law is unconstitutional are "wrong." Appearing on the March 23 Situation Room, Toobin hyped, "I actually think that Chief Justice Roberts and perhaps even Justice Scalia and Justice Alito might join Justice Kennedy in upholding the law." He added, "In striking this law down, it would really be a big change in Constitutional Law, and I'm not sure this court is ready to do it."
With his scathing dissenting opinion on the Supreme Court's overturning major parts of the Arizona illegal alien law, Justice Scalia is now my supreme hero. Chief Justice Roberts is a major disappointment in his lack of willingness to stand behind existing federal laws. I thought Roberts had more backbone.
