Cellphones, discipline lead policy decisions Michael Kelley on Wed Jun 05, 2013 5:35 PM CDT Corporal punishment is out and cellphones are in for students in the unified Memphis and Shelby County school district if two of a long list of proposed policies for the new district are approved Tuesday in a special called meeting of the unified board. “There will be a lot of jubilation” among MCS students, Internal Board Operations Committee Chair Betty Mallott observed Wednesday, if the board OKs the districtwide adoption of a cellphone policy that, with some exceptions, mirrors the policy in place at Shelby County Schools. All students would be allowed to take phones to school if they kept them turned off and properly stored in a locker, automobile or other school-approved location during the school day. Current MCS policy prohibits cellphone possession on campus. The proposed new policy calls for parents to pick up phones that have been confiscated for improper use at the close of the next school day follo ...
An eloquent meditation on Justice Anthony Kennedy, Shelby County, and the long view:
How can anyone...someone...try to tell me that just because a person does not have a child or children that he or she may not capable of making decisions concerning the future of the education of our children here in Memphis and Shelby County?! I can understand this particular person's point of view if he stated that a person who has never TAUGHT in either the city school system or the county school system may not be capable. But what does having or not having a child or children have to do with being able to make decisions concerning education anywhere?! He even said that money does not "follow" students when they leave public schools and go to charter or private schools. REALLY?! I have to have a child to be concerned about other children?! So does this mean that I cannot run for a Memphis City Council District position / seat now?! SMDH...
# VERY IMPORTANT READarticle below is from the Sheriffs Office addressing what the County Commission and Board of Education is trying to do without needed approval. I addressed this in my last posting. You will see our community and children still need our help if we expect officers in schools in August. The following news item has been added to the ShelbySO.com Current News page: Response to Funding Request 06/04/2013 9:43am Sheriff Chris Currys response to the recently proposed Shelby County Safe Schools Initiative funding plan as delivered on Monday, June 3, 2013: Approximately two weeks ago, Dr. Lewis Brooks, Shelby County Board of Education, delivered a document to me with dollar figures for the Safe Schools Initiative for additional funding to assist with school security. I was informed that the figures for the contribution by the Shelby County Commission of $270,000, the cities in Shelby County of $270,750 and the Sheriffs Office of $123,500 had been determined by County Manager Alex Dudchock. Roy Bean Before His ‘Law West Of The Pecos’ Days or “What you didn’t know about Judge Roy Bean” by Lois Zook Wauson Phantly Roy Bean was born west of Shelbyville in Shelby County, Kentucky prior to 1835 (some say as early as 1825). He was the son of Phantly R. Bean and Ann H. Bean. He had four brothers and sisters, they were: Sarah H. Bean, James C. Bean, Joshua H. Bean, and Samuel G. Bean. It is said that the name Phantly Roy, was a variant of the name Fauntleroy. The location of his birth is now a grove of locust trees. His older brother Samuel Bean went off to fight in the Mexican war. When Samuel Bean returned from the Mexican War he only stayed a short time before he left home for good in May of 1845. Roy set off a short time later to join him, perhaps when he was between 13 and15 years of age. The two brothers got a job driving a team of six yokes of oxen in a wagon train from Independence, Missouri, through Sante Fe, New Mexico, and down to Chihuahua, Mexico. In Chihuahua, Roy got crosswa ...
Looking for Hangings by Bob Bowman Before the electric chair gave Texas an alternative way of punishing murderers and the like, Texas counties had the local authority to hang criminals. Several old frontier jails in East Texas, such as those at Hemphill in Sabine County and Coldspring in San Jacinto County, still have gallows inside the jails as reminders of that era. And in the written and oral histories of many counties, hangings are mentioned prominently and graphically. At Carthage, the deputy and son of Panola County Sheriff James P. Forsythe was hanged by a mob in the winter of 1888 for killing the county's treasurer, Dennis C. Hill. At Lufkin, a man was hanged for raping a young girl in the early l900s, using a hastily-built gallows erected on Cotton Square, the town's central business area. Near Buena Vista in Shelby County, an 1892 hanging took the life of Joe Shields, a handsome and popular young man whose popularity was envied among other young men. But, as it turned out, there was more to the ...

Town names with a twist by Bob Bowman When it came to naming their towns, East Texans were not shy about their selections. Consider these examples. Jumbo, in Panola County, got its name from an elephant in P.T. Barnum’s circus. One of the largest African elephants in captivity, Jumbo was killed by a train while the circus was unloading in a Ontario, Canada, freight yard. Rake Pocket, also in Panola County, was named for the way merchants treated their customers. The community was later known as Pine Hill. Shakerag in Rusk County got its name from the sight of a young baseball player running the bases with a rag shaking in his back pocket. Pee Dee in Madison County go its name from the Pee Dee Indians of South Carolina. A family also named Pee Dee settled in Madison County and all eight members of the family died when someone poisoned a spring used by the family. Buena Vista, in Shelby County, was originally known as Buck Snort when Granny Elizabeth Richards tried to chase a large buck from her garden. T ...
Interesting article today in the Commercial Appeal. Buried on page 7B and written by Jane Roberts. I don't have an on-line account so can't give a link. "Veteran teachers say policy violates rights: Injunction seeks tenure as yardstick." I will share some highlights. A 10-year teacher went for an interview at American Way Middle School. As she was leaving, she "struck up a conversation with a Air Force career-changer on his way in, ready to meet principals. Under the new hiring rules in SCS, he has as much right to teacher openings as any displaced teacher with tenure. Of the 600 teacher openings for next year that have been filled so far, 26 percent - 156 jobs - have gone to people like him." "Lawyers representing the Memphis Education Association say the Shelby County school board is violating Henley's (the teacher's) constitutional rights and state laws that protect teachers' rights in mergers such as the one MCS and SCS are undergoing this year. Rick Colbert is a Nashville attorney representing ...

Born in a small cotton farming community in Shelby County on May 12, 1913, Jim never strayed from her native Texas, and neither did her heart. She is "Texan through and through," according to her family. During last year's terrible wild fires one of her sons called and asked if she was all right. She answered that she was and then said: "The bible says the world will be destroyed twice: once by water and once by fire, isn't that right?" When her son answered in the affirmative, she inquired further: "Do you think this is the one by fire?" When her son said: "Mama, Texas is not the whole world," Jim promptly replied: "It is to some of us!" The Dallas Mavericks, The Texas Rangers and The Dallas Cowboys have no more loyal fan than Jim. And of all the tributes paid to her at the very large cele ...

HISTORY: "Olaudah Equiano, was a slave who witnessed the rapes of slave women: "While I was thus employed by my master, I was often a witness to cruelties of every kind, which were exercised on my unhappy fellow slaves. I used frequently to have different cargoes of new Negroes in my care for sale; and it was almost a constant practice with our clerks, and other whites, to commit violent depredations on the chastity of the female slaves; and these I was, though with reluctance, obliged to submit to at all times, being unable to help them. When we have had some of these slaves on board my master's vessels, to carry them to other islands, or to America, I have known our mates to commit these acts most shamefully, to the disgrace, not of Christians only, but of men. I have even known them to gratify their brutal passion with females not ten years old." Henry Bibb, a slave from Shelby County, Kentucky, has argued: "A poor slave's wife can never be true to her husband contrary to the will of her master. She ca ...

A bill to allow Memphis families to send their children to private schools using taxpayer dollars, will be up for debate today. Governor Bill Haslam is behind the current proposal. It would allow about 6,500 state and local dollars to follow a child to a private school, instead of Shelby County schools. The proposal limits participation to low income children who attend a school in the bottom five percent statewide. That's 69 schools in memphis. The proposal also limits participation to 5,000 students in the first year. Today a house committee will take up the bill. Senator Brian Kelsey says he'll propose an amendment to expand the program to all low income students, regardless of where they go to school. This iso our hot topic. Do you think public money be used to support private school vouchers? (nw)

Justice Scalia’s contempt of Congress By Editorial Board,February 27, 2013 “THIS IS NOT the kind of a question you can leave to Congress,” Justice Antonin Scalia pronounced during a Supreme Court argument Wednesday. The subject was the Voting Rights Act, one of the most successful pieces of civil rights legislation in U.S. history, and in particular its Section 5. That provision requires nine states and assorted jurisdictions in seven others to win Justice Department approval before changing their voting laws. The burden is on these “covered” jurisdictions, unlike the rest of the country, to prove that such changes won’t adversely affect the right of African Americans and other minorities to vote. Shelby County, Ala., was in court Wednesday arguing that this pre-clearance requirement is an unfair infringement on Alabama’s sovereignty. Congress adopted the Voting Rights Act in 1965 and has reauthorized it four times since, most recently in 2006. Each time it has extended Section5 on the groun ...

For the past couple of days I've heard it said on TV that women don't support each other (speaking of business/career, and political). While that's a generalization, unfortunately I've witnessed this. Representing the majority of the US, TN, Shelby County & Memphis, women should be running things in my world. We can't hold panels about the need for more women in the C-suites, boardrooms, as biz owners, and in politics, then sit on the sidelines when a woman steps up to the plate. Come on sisters, let's do it for ourselves; standing on our own two feet and ringing our own bells (channeling Aretha and Annie)!
VRA Opposition: In the lawsuit, Shelby County, Ala., questions whether the preclearance requirement is still necessary to curb actions that would disenfranchise the vote. They argue that the racial and political biases that once existed have subsided, and that the suppression of the minority by the majority is only relevant in a historical context. Unfortunately, we don’t have to look far to see evidence to the contrary. The actions of state legislatures across this nation prior to the 2012 elections tell a compelling story. Of the nine states that are currently required to obtain preclearance from the federal government, six successfully passed restrictive voting legislation leading up to the 2012 presidential election, including Alabama. During its first year in power, our Republican-controlled state Legislature passed a law requiring a photo ID to cast a ballot, in spite of the fact that such a mandate disportionately affects minorities, seniors and the disabled who are less likely to have such ident ...
Filing from the federal judge concerning Masson's appointment as special master of the school merger: On September 28, 2011, the Court approved a Consent Decree governing the transfer of administration of the Memphis City Schools to the Board of Education of Shelby County, Tennessee (the “Shelby County Board of Education”). The transfer is to become effective at the start of the school year in 2013. Under the terms of the Consent Decree, the Court retains jurisdiction to enforce the Consent Decree and has the authority to appoint a special master to assist in implementing the Decree. By order dated February 25, 2013, the Court invited the parties to submit responses addressing whether a special master Case 2:11-cv-02101-SHM-cgc Document 500 Filed 03/05/13 Page 1 of 5 PageID 12405 2 should be appointed at this time, what the duties of a special master should be, and who might be considered. At a conference this weekend, I heard a presentation on Shelby County v. Holder, the Supreme Court case challenging Section 5 of the Voting Rights Act (and only Section 5 – the rest of the law will remain unchanged, regardless of the outcome of the case).  Not surprisingly, given that the room was dominated by people who lean strongly to the left, there was a great deal of hand-wringing and anxiety over the fact that the speaker expects the Court to overturn that section of this undeniably historically important piece of legislation.  What I learned in the process, however, only further convinced me that that section 5 of the Act is, in fact, unconstitutional and should be thrown out.  Just as importantly, the blame does not lie with the Supreme Court, or with Republicans, although I suspect that they will be identified as the culprits in most discussions about the issue.  The blame lies with Congress, and particularly with members of Congress from blue states like New York and California, because o ...
While attention is focused on the 30-foot wide sinkhole that swallowed a man alive in Florida, much bigger holes routinely open up in Alabama. A map of the state maintained by the Geologic Survey of Alabama is covered in dots representing sinkholes in the state, with new holes added all the time. One of the largest sinkholes in U.S. history opened up in Shelby County, Alabama in 1972.       Known as the Golly Hole, it measures more than 300 feet across, as wide as a football field is long. Residents reported hearing a tremendous roar as the hole opened up and swallowed trees and everything else in the vicinity, according to media accounts of the time.       "Alabama does have a number of sinkholes across the state. Primarily, they are located in north Alabama and south Alabama," said Sandy Ebersole, with the Geological Survey of Alabama. "Northern Alabama has a lot of soft limestone, which is responsible for a lot of sinkhole formation."     Maps maintained by the U.S. Ge ...
Shelby County's grant resources expected to shrink
So you don't vote ... Never have or you may think your vote won't count so why bother ... The US Supreme heard arguments last week about the Land Mark 1965 Vote Rights Act . The case came from Shelby County ,Alabama and Justice Antonin Scalia branded the law as "racial entitlement ". Think about that .. a right that is given to ALL Americans .. That Legislation gave Black Voters The right to vote who had been denied that basic right . The right to vote is power we all have .. The right to elect people of our choice.. Inputs in important decision that affect where we live ... Our children's education and safety no matter what our skin color is ... So Shelby county , Ala and Justice Scalia ... Read the 15th Amendment of the US Constitution which gave us the right to vote (1870) ... Alabama and most southern states denied us that right because of Jim Crow laws and it took another 95yrs to have full voting rights ... No Justice Scalia not "racial entitlements ". A RIGHT!
Why march for the right to vote today? Because the Supreme Court is considering repealing Section 5 of the Voting Rights Act, the part that allows Justice Department in some Southern states, and other states that have a history of past discrimination. The case is Shelby County (Alabama) V. Holder (Justice Department). In Shelby County, with one black man on the city council, the small town he represented gerrymandered districts to get him out of his seat (they say that was not their intent) and the Justice Department stepped in. Now they are suing, saying there is no discrimination. Hmmm. I'm not surprised that a dozen or more Attorneys General in Southern States and City Attorneys have filed amicus briefs. In his comments last week, Justice Antonin Scalia says there is no need for Secction 5.
Good Morning! I am listening to arguments at the Supreme Court for Shelby County vs Holder. I am a little confused on why we need so many laws. On the subject of voting. I think 1 law is all we need. Part 1: If you are 18 or older, a citizen, and not a felon you can vote. Part 2: All districts will be created using census information and will be divided equally based on eligible voters starting in the center of the state and will be square in shape. These will be created using a computer program and will not allow for any district in the state to be 3% larger than any other district. Part 3: All public high schools will be designated as a voting location. With todays technology all voting will be electronic and you can vote at any high school in your state. At no time should anything except citizens who are eligible to vote be used to determine anything! We currently have too many laws. These laws constantly contradict each other, cause confusion, and make them useless.

MAZEL AND JACKHOLE(s) of the Week!!! This week has been FILLED with Jackholes…I had a hard time selection the top pick, but have made my choice. This week’s Jackhole of the week goes to (drum roll...CHING!) Supreme Court Justice Antonin Scalia! (Applaud-Applaud!!) Scalia has the winning Jackhole position for his SO-CALLED impartial opinion in the current Voters Right Act of 1965 case Shelby County, Alabama V. Eric H. Holder Jr., Attorney General of the United States of America, et al. Scalia said “I don’t think (Congress‘ renewal of the law is’) attributable to the fact that it is so much clearer now that we need this. I think it is attributable, very likely attributable, to a phenomenon that is called perpetuation of racial entitlement,” Hmm…racial entitlements (thinking-thinking…), no, entitlement?? I don’t think so!!! Scalia has been stuck in his ivory tower too long and is just not in touch with real people and the things that affect them (I could start with my thoughts on the ...

Feb. 25, 2013 - Congressman Butterfield discusses the importance of Section 5 of the Voting Rights Act. Section 5 is being challenged by Shelby County, Alabama.
Did you know.Texas Governor Oran M. Roberts signed the charter that established the University of Texas in 1883, was one of UT’s first law professors and became the founding President of the Texas State Historical Commission, but he first practiced law in Shelbyville and established a farm in southern Shelby County called Roberts’ Hill? According to the historical marker on the property, "Roberts' Hill is a home-site of Col. Oran Milo Roberts, 'Old Alcalde.' He rose from district attorney to chief Justice Texas Supreme Court; President Texas Secession Convention; Col. Confederate Infantry Regiment; U.S. Senator; Governor of Texas; author, First President Texas Historical Association; law professor University of Texas." And, it was as a law professor at UT that his students gave him the nickname of the "Old Alcalde" (pronounced “all-call-day”). This affectionate title for Professor Roberts lives on as the name of the alumni magazine for The University of Texas. Be sure to visit the website for the ...

"Shelby County still advertises itself as the heart of the Heart of Dixie."
Scalia called Section 5 the "perpetuation of a racial entitlement" that legislators would never have the courage to overturn." Not surprising from Scalia, but still atrocious to know we have Supreme Court Justices with such contempt for the rights of minorities. I guess our right to a fair vote will always be an "entitlement" to some people. ""Do you think the right to vote is a racial entitlement in Section 5?" Sotomayor asked. "No," Rein (lead attorney against Section 5) said, "the 15th Amendment protects the right of all to vote." It should, but sometimes it doesn't. That's why Congress passed Section 5 (Senate 98-0 in 2006)." Exactly and it is horrible that Shelby County, Alabama is the plaintiff. In 2008, the city of Calera in Shelby County redrew one of its electoral maps to reduce the percentage of African-Americans in the sole majority-minority district (Calera is 23% AA). The new map reduced the percentage of African-American voters from 70.9% all the way down to 29.5% in District 2. The city of ...
IT IS THE 21ST CENTURY??? IT SEEMS WE AS A RACE ARE GOING BACKWARD... THERE ARE SO MANY BIGOTED PEOPLE OUT THERE. WE DON'T SEEM TO LEARN NOTHING FROM HISTORY... "By Greg Palast, author, “Billionaires and Ballot Bandits: How to Steal an Election in 9 Easy Steps” "Jim Crow is alive and well — and he has mounted a new attack on the law Martin Luther King dreamed of: the Voting Rights Act." "On February 27, the Supreme Court will hear a suit brought by Shelby County, Alabama, which challenges the right of the Department of Justice to review changes in voting procedure. Example: Attempts to cut the number of early voting days, to expunge “illegal alien” voters without any evidence, refusing Spanish-language ballots, have been blocked by the Department of Justice and Courts because they have stopped Black and Hispanic citizens casting ballots." "Sixteen states are subject to this “pre-clearance” law, every one with a history of Jim Crow rules such as “literacy” tests — Blacks had to recite . ...

Black History Moment...Whitney Moore Young, Jr ( July 31, 1921 – March 11, 1971)...Young was born in Shelby County, Kentucky, on July 31, 1921 to educated parents. His father was the president of the Lincoln Institute, which was where Whitney was raised and educated. Whitney's mother, Laura Young, was the first female postmistress in Kentucky, the first African-American postmistress in Kentucky, and the second in the United States. Young earned a bachelor of science degree from Kentucky State University, a historically black institution. At Kentucky State, Young became a member of Alpha Phi Alpha fraternity. During World War II, Young was trained in electrical engineering at MIT. He was then assigned to a road construction crew of black soldiers supervised by Southern white officers. After just three weeks, he was promoted from private to first sergeant, creating hostility on both sides. Despite the tension, Young was able to mediate effectively between his white officers and black soldiers angry at the ...

The city has not made any indication that they will remove the mausoleum containing Forrest's body from the park nor have they told the Klan that they have to stop holding a rally every year on the anniversary of the death of Dr. King. The KKK has promised its largest rally ever, in response to the renaming of the parks. "It's not going to be 20 or 30," [the Tennessee area KKK leader] said. Colorado Sheriffs standing on 2nd Amendment. by Matt Arnold on Wednesday, 23 January 2013 at 18:49 ·... By my count, the number of Colorado Sheriffs standing firm on supporting the constitutional rights of Colorado citizens is growing; with the notable exception of Arapahoe County Sheriff Grayson Robinson (associate of disgraced former Arapahoe County Sheriff Pat Sullivan, convicted of trading meth for sex with *** prostitutes), a strong majority of the highest ranking law enforcement officers in the majority of Colorado counties honor their oath. Please contact YOUR local sheriff and ask for their position:Do they stand with the citizens and the 2nd Amendment, or do they stand with untrammeled government power irrespective of constitutional authority? “An unconstitutional act is not a law; it confers no rights; it imposes no duties; it affords no protection; it creates no office; it is in legal contemplation as inoperative as though it had never been passed.” Norton v. During my set I got to interact with both the Memphis city mayor and the Shelby County mayor as well along with high ranking members of the SA. I wasn't sure what to expect because I've never seen a Kroc Center but it's really awesome and huge. It has its own indoor water park, gymnasium, workout center, classrooms, all kinds fun things for the kids and adults alike. No matter what age you are there's something there for you. They also have a performing arts section to the building with a very nice size theater and a stage big enough to accommodate an orchestra. I was asked to come back in the future to perform more dates there and I'm looking forward to it. Here are a couple of promo pics taken there.

Whitney M. Young, Jr. was born in Shelby County, Kentucky to well educated parents. After serving as sergeant in World War II, he became interested in race relations. He added to his bachelor of science degree by pursuing a master's in social work. His academics prepared him for a career of ensuring justice, equality and equity for blacks. In 1961, he became Executive Director of the National Urban League, transforming it into an organization that aggressively worked toward securing jobs, for blacks, that were orginally reserved for Whites. Whitney involved this organization (which involved many Whites) into the civil rights movement. He was well respected among US presidents and made a great impact on The State of Georgia's Conference of Social Welfare. He quoted once, "You can holler, protest, march, picket and demonstrate, but somebody must be able to sit in on the strategy conferences and plot a course. There must be strategies, the researchers, the professionals to carry out the program. That's our r ...

Bishop Charles Harrison Mason Early Childhood Bishop Mason was born the son of former slaves Jerry and Eliza Mason in Shelby County, Tennessee. He lived with his family in an unincorporated area near Bartlett. Mason worked with his family sharecropping and he did not receive an early formal education. As a child, Mason was influenced by the religion of his parents. In 1879, when he was twelve, Mason joined the African-American Missionary Baptist Church; he was later baptized by his older brother, Rev. I. S. Nelson. In 1893, he began his ministerial career by accepting a local license from the Mount Gale Missionary Baptist Church in Preston, AR. On November 1, 1893 Mason entered the Arkansas Baptist College, but withdrew after three months because of his dissatisfaction with their curriculum and methodology. Conversion At this period he became enamored with the autobiography of Amanda Berry Smith, an African American Methodist evangelist. Smith had become a convert of the new wave of Holiness that was spre ...

After being in the community for 70 years and now the last remaining indoor theater in Shelby County, this year(2013), the movie industry is going digital and we will no longer be able to show movies on our existing equipment. Its not that we have bad equipment- just the movie industry is making everyone change. The cost of these digital projectors is $66,000- which is more than the current owners can come up with on there own. (They have been operating the theater since 1982). This has lead us to launch the “Digital Campaign Fund.” We are looking for support from the community and the surrounding communities to help us reach our goal and keep the theater alive. We know this might sound like a big challenge but we know we can make it happen! Below is an FAQ. If you need further information please E-Mail or call us and we will get back to you.   What is the digital conversion? The digital conversion is the phasing out of traditional 35mm film which the industry has been running on for the past century ...

I had to share this, out of all the post I have seen about the incident yesterday, this one has more truth to it...Brian Hatcher Everybody wants to slam the County Commission but its the Board of Educations responsibility to provide and fund school security. They are appropriated funding for that purpose. Emotions are high (understandably) but you have to remember that Shelby County was nearly bankrupt (as bad as Jefferson Co) 20 years ago and THIS commission seated has brought us from that to one of the most stable (and credit worthy) counties in the state. On top of that there WAS a deputy ONSITE at the school when this happened and he diffused the situation correctly and efficiently. We have a great group of commissioners and they do an excellent job of running our county. You have to work within your budget and life would get a whole lot WORSE around here if we went bankrupt from not staying within budget. I want nothing more than for Sherrif Curry to have enough money to provide 150% security for us ...
