Alaska invokes Civil War-era law in lawsuit for Izembek road Phil Taylor, E&E reporter Published: Tuesday, April 8, 2014 Alaska announced plans yesterday to sue the Interior Department under a Civil War-era mining law to build a road through the Izembek National Wildlife Refuge, a new twist in a decadeslong controversy. The state filed a notice of intent to sue under Revised Statute 2477, an 1866 law designed to promote settlement in the Western frontier. It follows Interior Secretary Sally Jewell's decision late last year to reject a proposed land swap that would allow about 10 miles of gravel road through the refuge wilderness. The state's claimed right of way follows a similar route. R.S. 2477 offered miners and homesteaders an opportunity to build trails or roads over any public lands not yet reserved or claimed for private use. ANCHORAGE, Alaska (AP) â Alaska Gov. Sean Parnell says his state will sue the federal government to put a road through a national wildlife refuge. The Republican says in a news release Monday that the village of King Cove needs access to emergency medical flights provided at an all-weather airport in Cold Bay. Parnell says it was unconscionable for the Interior Department to reject the one-lane gravel road through the Izembek (EYE'-zem-bek) National Wildlife Refuge in December. Environmental groups strongly oppose the road planned for an isthmus along the 150-square-mile Izembek Lagoon. The lagoon is home to world's largest-known bed of eelgrass, which provides fodder to migratory waterfowl â such as Pacific brant, endangered Steller's eiders â as they head south for the winter.
Police Chief Ken DeSimone officially retired from the U.S. Marine Corps on April 1 after 32 years of service. Retiring at the rank of Colonel, he served in both the armor and military police fields. He is both an Iraq and Afghanistan War Veteran. In 2005 he was the Multi-National Forces-West coordinator for the Ministry of Interior Department of Border Enforcement, Iraqi Border Police, in the Anbar and Najaf Provinces. In 2011 he was the Officer in Charge of the Second Marine Division Provincial Police Advisor Team and advisor to the Helmand Province Afghanistan Chief of Police. Chief DeSimone has worked on the tactical and operational level with police and military forces in North America, Europe, Asia, Africa and the Middle East. His last assignment was at the Marine Corps Base, Camp Lejeune, NC, Provost Marshal's Office, Base Security and Emergency Services. A ceremony honoring Colonel Ken DeSimone will be held in June.
