7/n 1975 Indira Gandhi's election was made null and void by Raj Narayan's case in Allahabad High Court ... Modi's MPship be cancelled
Mmm: In the election speeches of Mr.Narendra Modi or Mr.Arvind kejriwal the voters are told to totally wipe out the opposition. Mr.Modi wants "Congress Mukht Bharath" and Mr.Kejriwal's war cry is to wipe out both congress and BJP. For this he says his party will take support from all forces (even dubious ones). It's dangerous for democracy if any party gets a huge brutal majority and leaves the opposition benches almost empty. In fact if we go back in history this is what happened in 1971 when the congress party led by Smt.Indira Gandhi got a brutal majority of 352 seats out of 518 and the main opposition parties were CPI with just 25 seats, CPM with 23 seats and Bharatiya Jan Sangh (BJP) with 22 seats. When her election was set aside by the Allahabad High court, using this brutal majority she declared "EMERGENCY" which was one of the darkest period in Indian Democracy. For a democracy to flourish and survive a strong opposition in the parliament is as important as a stable government at the centre.
SHRI PRAKASH JAVADEKAR ON Sushil Kumar SHINDE AND Rahul Gandhi BJP condemns Home Minister Sushil Kumar Shinde for his outburst against media. This shows their panic with rising groundswell for BJP led by Shri Narendra Modi in the coming elections. The recent Assembly Poll results have gone against Congress. The writing on the wall is clear. Therefore Congress is now threatening the media. It reflects the dictatorial DNA of Congress. Congress is democratic only when it has a comfortable majority. The moment it sees its inevitable defeat, it goes back to its basic DNA of dictatorship. This is what precisely happened in 1975. There was groundswell support for JP movement, the Allahabad High Court unseated Mrs. Indira Gandhi and the Gujarat State Assembly elections results went against Congress. The basic DNA of Congress prevailed and “Emergency” was imposed thereby snatching away the freedom of expression of the press and the people. Rahul Gandhi will campaign in North-East for next two days after Narend ...

Q. 4. Who filed a case against Indira Gandhi in Allahabad High court after General Elections of 1971 ?
April 28th 1976 is remembered as a black day in the history of Indian Democracy. The reason for this were to be found in the election of Mrs Indira Gandhi (the then prime minster of India) which had been held to be invalid by the Allahabad High Court. In her desire to stick to the chair of prime minster she chose to declare a national emergency on 25th June 1975 on the ground of ‘internal threat’ to the security of India. As a result of the emergency censorship was imposed on the press on 25th June 1975 itself. On 5th August 1975, Maintenance of Internal Security Act (MISA) was approved by the parliament and a number of opposition leaders were detained under this law. Any person who was considered to be a political threat or who could raise the voice of opposition was detained without trial under the MISA. According to Amnesty International, 1, 40,000 persons were arrested without trial during the emergency period.
38 years ago, on the morning of 12 June 1975, in room No. 15 of the Allahabad High Court, Justice Sinha found Indira Gandhi guilty on two counts for corrupt practices under Section 123 (7) of the Representation of the People Act, 1951.

Article 50 of the Constitution of India. Indira Gandhi vs. Raj Narain (AIR 1975 SC 2299) " The judgments given by Allahabad High Court and the Supreme Court stand for good Example of Independence of Judiciary."
Post Independence:- The city and the district became famous as a political bastion of the Nehru-Gandhi Nationalist family. After independence, Rae Bareli constituency was won by Jawaharlal Nehru's son-in-law Feroze Gandhi. After Feroze Gandhi's death in 1960, the constituency was won in 1967 by his wife Indira Gandhi (daughter of Jawaharlal Nehru), who went on to become the first woman Prime Minister of India. In 1977, after Indira Gandhi's election from Rae Bareli was revoked by Allahabad High Court for using state machinery in the elections. She held on to the power by having the President of India declare a national emergency.
Nineteen-seventy-four was a cruel year. The Congress party appeared to be withering away amid rising prices, student protests, trade union strikes and public rallies. Leaders like J P Narayan toured India with one slogan to restructure India's democracy - total revolution. On June 12 1975, the Allahabad High Court – acting on an election petition filed by Raj Narain - ruled that Indira Gandhi's election was invalid. Crowds surrounded Parliament demanding her resignation. President Fakruddin Ali Ahmed, under Indira Gandhi's instructions, imposed the Emergency on June 26, 1975. India, the proud democracy, was transformed overnight into a tinpot dictatorship and was brought, in Indira's own words, to a grinding halt. Political leaders were thrown in jail. The infamous 20-point programme was declared to revive the Indian economy. Courts were gagged and the press was muzzled. The Indian Express comes out with its famous editorial: it is simply blank. Then in January 23 1977, Indira Gandhi called fresh electi ...
calling Indira Gandhi as a Stateswoman, a sensible and able politician is a mockery of the said words.she was nothing a but a very shallow person who rode the crest of her father's legacy.two important situations she faced as a Prime Minister.social unrest against her admn and setting aside of her election by the Allahabad High Court and she imposes EMERGENCY in 1975 and second is instead of redressing the grievances of Sikhs she orders OPERATION BLUE STAR.long live Indian Democracy.

Turning Point : The Gandhi dynasty dominance must end By Abhay Vaidya The Gandhi dynasty’s dominance over Indian politics has to end some day and what we are witnessing today is perhaps a turning point in history. No matter how hard the Congress defends Robert Vadra in order to insulate his DLF deals from impacting his mother-in-law and party president Sonia Gandhi, the fact is that the Congress has already lost the battle of perception in the mango orchard. The aam admi- “mango people” in Robert Vadra’s words – are more than convinced that the Vadra-DLF deal is not as innocent a business deal as made out by the Congress. This perception has been further reinforced by reportage in the national press – across print, broadcast and the internet. It was just a matter of time before a Public Interest Litigation (PIL) was filed in the Vadra-DLF case. That is precisely what happened on Thursday with the Lucknow bench of the Allahabad High Court asking the Union government why Kejriwal’s allegations ...

Looks like Allahabad High Court n the Gandhi family has a long-standing relationship :D Gandhi
26th June 1975 - The Black Day It was on this day, Emergency was imposed on the Country. All this was done to protect Indira Gandhi who was unseated from Lok Sabha, following the judgement of Allahabad High Court. On the mid night of 25th June, Sh Fakrrudhin Ali Ahmed, the then President, ignoring all his Constitutional responsibilities signed the proclamation and almost punched a death blow to our democratic system. Simultaneously, Censorship was imposed on the Press and thousands of social and political activists were detained under the draconian provisions of DIR/MISA. What followed was a sustained, peaceful and mass struggle for restoration of Rule of Law in the country. Today, unfortunately, many including the media, prefer to ignore and forget the stellar role played by the Sangh Parivar in struggle for restoration of democracy. On this day, let us remember and salute those brave hearts who laid down their lives and suffered untold hardship so that we remain free and live with respect and dignity.
