Former UP chief secretary Neera Yadav gets bail The Allahabad High Court has granted bail to former Uttar Pradesh chief secretary Neera Yadav who was recently sentenced to three years' imprisonment by a special CBI court in a Noida land scam case. In an order on December 05, Justice Mohd Tahir ruled that Yadav be released on bail "during the pendency of the appeal on her furnishing a personal bond and two sureties each of the like amount to the satisfaction of the court concerned". The 1971 batch IAS officer, who retired from service in 2008, had moved the court with an application under Section 374 of the Criminal Procedure Code whereby she had challenged the order of the CBI court at Ghaziabad of November 20. Admitting her application and granting her prayer for bail, the High Court summoned the lower court records with the direction that the appeal be listed for hearing "in due course". Azharuddin's life ban lifted by AP High Court Bangalore, November 08 Former India skipper Mohammad Azharuddin's life ban was today lifted by the Andhra Pradesh High Court. The BCCI had banned Azhar in 2000 for his involvement in the match-fixing scandal, after he was named by then South African skipper Hansie Cronje. Azharuddin had challenged the life-ban that was handed out to him, but the decision was upheld by the City Civil Court. Subsequently, the 49 year old who is currently a member of parliament in Uttar Pradesh, moved the AP High Court, who lifted the decision. Azhar, in a press conference, said that he was very happy with the judgement. "I am very happy with today's judgement and I won't want to blame anybody. The Allahabad High Court on Tuesday directed the Akhilesh Yadav government to spell out its stand on banning gutka (tobacco pan masala) in Uttar Pradesh within two weeks, and warned if it failed to act, the court would itself slap a ban.

The Union Cabinet, at a meeting chaired by Prime Minister Manmohan Singh, approved a proposal to amend Article 16(4) of the Constitution to remove the term "inadequate representation" to justify reservation in promotion and appointments. Most of the parties had earlier supported the demand for this bill but Samajwadi Party had opposed it. he CBI today approached the Supreme Court against Uttar Pradesh minister Balram Singh Yadav, also a close aide of SP chief Mulayam Singh Yadav, to prosecute him in the 1996 multi-crore Ayurveda scam. The investigating agency moved the Apex Court challenging the Allahabad High Court order of quashing criminal proceeding against Yadav who was the state’s health minister at the time of the scam. The high court had last year quashed the proceedings against Yadav, at present Panchyati Raj minister, saying that proper sanction was not taken from the competent authority to prosecute him. Agreeing to hear the CBI’s appeal, a bench of justices H L Dattu and C K Prasad issued notice to Yadav. The Ayurveda scam running into crores of rupees came into light in 1996. The probe was entrusted to CBI, which named 106 people as accused in the charge sheet including Yadav. The trial before the special court began in 2001, but a number of accused approached the high court, which granted them stay.
The UPA government’s decision to introduce a bill to provide reservation for the Scheduled Castes and the Scheduled Tribes in promotions in government jobs is surprising. The Supreme Court has upheld a High Court decision striking down reservation for the SCs and the STs in promotions introduced by the Uttar Pradesh Government. Promotions in jobs are to do with individuals, not social groups. Merit, efficiency and dedication should be the criteria for promoting a person. The socially handicapped are already being taken care of by reservation in recruitments. The government should have convened an all-party meeting to discuss the issue.

The Supreme Court on Friday set aside Uttar Pradesh Government’s decision to provide reservations in Government job promotions. The decision, introduced in 2007 by the then Mayawati Government, had caused major furore in the State with over 10 lakh employees being aggrieved by the decision to reserve promotions to top posts for Scheduled Castes, Scheduled Tribes and Other Backward Classes.
