R.I. moves to add municipalities, others as defendants in pension lawsuit May 30, 2014 11:15 PM Comments 0 0 3 +10 0 0 2 By Tom Mooney Journal Staff Writer tmooney Related Superior Court Judge Sarah Taft-Carter WARWICK, R.I. — The number of lawyers engaged in the lawsuit challenging the state’s 2011 pension overhaul is poised to swell. The state has asked that virtually every Rhode Island municipality, school department, water authority, housing authority and even library board, with workers who pay into the state retirement system or have collective bargaining agreements with workers, be added as defendants in the lawsuit. In motions filed Thursday, lawyers for the state argue that whether the half-dozen unions and retirement groups suing the state are successful in getting their reduced benefits restored, repercussions will affect virtually every community and scores of other entities with public sector workers. Therefore their interests must be represented as the lawsuit proceeds. For instance, ...
FRIDAY MARCH 3, 1995 Ad In Magazine Led To Marriage -- Photo Of Future Wife Intrigued Timothy Blackwell By Peyton Whitely, Alex Tizon, Dave Birkland, Richard Seven, Mary Rothschild, Duff Wilson, Susan Byrnes Susana Remerata Blackwell's photograph in an issue of "Asian Encounters" magazine 3 1/2 years ago showed a pretty, petite, 22-year-old Filipina who wanted an American friend. Timothy Blackwell, a lab technician twice her age, liked what he saw. He began their courtship by mail from his studio apartment in North Seattle. After more than a year's correspondence, the two married in the Philippines, a union that seemed to meet both their needs. But a little more than a week after Susana Remerata Blackwell came to the United States, she told police that Tim Blackwell had assaulted her. Yesterday, after a yearlong court battle involving annulment, divorce and deportation - and just minutes before final arguments in the case were to begin - Tim Blackwell pulled out a semiautomatic handgun in the courthouse h ...

Federal court rules postcard-only policy in Ventura County jails is unconstitutional By Cindy Von Quednow Posted May 30, 2014 at 12:28 p.m., updated May 30, 2014 at 1:14 p.m. A U.S. District Court has ruled that the Ventura County Sheriff’s Office policy that allows jail inmates to receive only postcards is unconstitutional. The policy prevents inmates from receiving mail such as Prison Legal News, which responded by suing Sheriff Geoff Dean, Assistant Sheriff Gary Pentis and commanders in charge of the county’s two jails. “We are very pleased the judge is upholding the constitution,” Paul Wright, editor of Prison Legal News, said in a statement. Ernest Galvan, an attorney representing the publication, had previously told The Star that the policy violates First Amendment rights of inmates and their loved ones outside of jail partly because they cannot receive mail that could be beneficial to their future. Prison Legal News, a project of the Washington-based Human Rights Defense Center, focuses on ...

Jeffrey Holzworth, 52, pleaded guilty in April to one count of theft and 11 counts of receiving stolen property between 2005 and 2012 as part of a plea agreement for the four-year term. Holzworth was sentenced on the grand theft charge and an enhancement alleging a loss of more than $100,000. The concurrent sentences for the receiving stolen property charges were stayed. Holzworth had faced 12 years and four months in prison and the amount he actually stole is believed to be around $286,000, prosecutors said. Sonoma County Superior Court Judge Jamie Thistlethwaite told Holzworth, "You were greedy. It got too easy and it became your lifestyle." GORDON MAYOR'S PICK HELD IN CONTEMPT, SPENT TIME IN JAIL By Judy Bailey The Wilkinson County Post MAY 29, 2014 The Monticello attorney Gordon Mayor Mary Ann Whipple Lue tapped as the city’s interim attorney was ordered to spend 10 days in Jasper County Jail in 2011 for contempt of court. Lue’s appointment came less than 48 hours after casting the questionable deciding vote to terminate the city’s 40-plus year veteran attorney, Joe Boone. Lue gave the nod to Ronny E. Jones of Monticello on Friday. The mayor signed a financial agreement with Jones to pay him $200 an hour, the same pay Boone received. Jones lists no government law experience on a website profile. Superior Court Senior Judge Levi A. McConnell Jr. found Jones in contempt of court for failing or refusing to pay fees related to his 2011 divorce, according to the July 18, 2011, order filed in Jasper County Superior Court. McDonnell ordered Jones detained in the county jail until he paid $1,810 in attorneys fees to a Milledgeville attorney a ...

SEATTLE, WA, May 29, 2014 (LifeSiteNews.com) – A Washington judge last week denied a request by Eastside Catholic School and the Archdiocese of Seattle to dismiss a discrimination lawsuit filed by the school’s former vice principal, who was forced to resign in December for “marrying” his homosexual lover. Mark Zmuda sued Eastside Catholic in March, claiming the school violated its own discrimination policy in asking him to leave his job. But the school has repeatedly pointed to the morality clause Zmuda and all diocesan employees have signed, agreeing to publicly uphold the teachings of the Catholic faith, which expressly forbid same-sex “marriage.” School and archdiocesan attorneys asked King County Superior Court Judge Catherine Shaffer to toss out the suit, arguing that the court had no jurisdiction to rule on the case without violating the school’s first amendment right to freedom of religion. But in a decision issued Friday, Shaffer disagreed, writing, “The Federal and Supreme Court . ...

Graco Recalls Car Seats Over Faulty Buckle By CHRISTOPHER JENSEN February 11, 2014 Graco Children’s Products is recalling almost 3.8 million car seats because faulty buckles can make it hard to free the child in an emergency, the company said on Tuesday. But federal safety regulators said the recall, the largest in five years, did not go far enough, and have asked for an additional 1.8 million seats to be included because they use the same buckles. In an unusual move, the National Highway Traffic Safety Administration told Graco in a letter that unless those additional seats were fixed it would take legal action to force a recall. The seats in the recall are the 2009 to 2013 model years of the Cozy Cline, Comfort Sport, Classic Ride 50, My Ride 65, My Ride with Safety Surround, My Ride 70, Size 4 Me 70, Smartseat, Nautilus, Nautilus Elite and Argos 70. This, even though the New Jersey Department of Education (DOE) repeatedly stated publicly, during the board's exercising of its autonomous search authority, that it had no legal authority to involve itself in pushing for any candidate. A schedule will be set for briefing by the parties and oral argument in December, after which the Court is expected to issue a decision on the pending claims related to the merits of NH Fish & Games's proposed boat launch project on the "Wild Goose" conservation site. The Superior Court had twice ruled that the State's decision to move forward with construction of the project violated the requirements of RSA 162-C:6 which requires the State to manage all LCIP lands "so as to preserve the n ...

UPDATE: Sources say car theft involved in King City police corruption case King City: Former, acting chief, officers arrested in corruption scandal By VIRGINIA HENNESSEY Herald Staff Writer POSTED: 02/25/2014 09:07:12 AM PST | UPDATED: 63 MIN. AGO The highest ranking officers in the King City Police Department for years targeted the city's most vulnerable citizens, District Attorney Dean Flippo said Tuesday, essentially stealing their cars for profit. In what is likely the most widespread case of official corruption in Monterey County history, six King City police officers, including both the former and acting chiefs of police, were arrested on felony charges Tuesday, four of them accused of conspiracy, embezzlement and bribery. The owner of a local tow truck company, the brother of the acting chief, was also arrested in the scheme, which involved impounding the cars of mostly unlicensed drivers, then selling them when the cars owners were unable to pay the towing and storage fees. Prosecutor Steve So ...

**BREAKING NEWS*** Major Victory for Indigent Health Care in Fresno County! Our client base won a major victory today when a Court ruling protected access to health care for indigent Fresno County residents. Residents who do not qualify for Medi-Cal or Covered California health plans will continue to benefit from an injunction won by Central California Legal Services, Inc. and California Rural Legal Assistance, Inc. in 1984. Judge Donald Black of the Fresno County Superior Court tentatively denied Fresno County's attempt to cancel the injunction that has prevented the County from illegally denying health care to low-income residents for the past 30 years. The County sought to dissolve the injunction late last year, with no notice to CCLS, CRLA or the public. A ruling by the judge on New Year's Eve afternoon kept the injunction in place until legal arguments and evidence could be presented, and a hearing was set for February 26. Today, the Judge tentatively ruled that the County failed to demonstrate that ...

Filing Additional Declarations After The Hearing In King County Superior Court, for Family Law Department hearings, as a general rule, there are page limits that each party can file for a hearing. Currently that page limit is 25 pages for the moving party and 20 pages for the non-moving party. This page limit has several rules, such as margin and size of font specifications as well as a requirement that the spacing be double. In many cases, with a bit of planning, the declaration page limitations work out OK. But there are times with I have a client who wants to submit more declarations than the rule allows. Unfortunately this is not going to happen, for the hearing, but it is not uncommon to submit additional declarations after the hearing has taken place. The page limits are designed to limit the amount of paperwork that the Court Commissioner has to read for the hearing, not what is filed in the court file. So why would a party want to file declarations in the court file that were not used at a hea ...

USA OAKLAND JUDGE ASKED AMERICAN LEGAL SERVICES TO PAY RECORD $ 15.1 MILLION AS COMPENSATION TO CITY FOR FALSELY BILLING ITSELF BY CHARGING IMMIGRANTS EXORBITANT UP FRONT FEES BUT CITY IS NOT HOPING TO RECEIVE FULL MONEY AND SO FAR RECEIVED $ 200,000 FOR 18 VICTIMS 23RD NOVEMBER 2013 OAKLAND -- The city has won a record $15.1 million judgment against a company it said preyed on immigrants seeking to remain in the U.S. legally. American Legal Services, according to the city, falsely billed itself as immigration law experts, and routinely botched visa and citizenship applications after charging exorbitant upfront fees. One couple seeking citizenship ended up getting deported, leaving behind their three U.S. born children. In another case, the company advised a woman to return to Mexico with her two daughters so that she could apply for a visa, but immigration officials never let her back into the country to be reunited with her husband. "This was a morally bankrupt enterprise," City Attorney Barbara Parker ...

The lawsuit had initially been filed in San Francisco Superior Court, but was subsequently moved to the Alameda County Superior Court when the project's architects Anshen + Allen / Stantec claimed it couldn't get a fair hearing or trial in San Francisco. You may recall that the principal architect at Anshen + Allen on the LHH rebuild project was none other than Derek Parker, who conveniently was simultaneously a member of the board ...
Here is the story -- typical in Arizona. No followup, resulting in multiple deaths.. Hours before her death, Carol Sanders tells judge “He was going to kill me” Posted: 16 Nov 2013 09:02 AM PST On Tuesday morning, the woman went before a court commissioner, her voice shaking as she asked the state of Arizona to protect her from her husband. Carol Sanders described what it was like to live in fear, to walk on eggshells around what was essentially a lit fuse, wondering when he would go off and whether she and her 14-year-old daughter would survive it. “We were desperate to calm him down …,” she told the commissioner, describing one incident. “What I thought was going to happen was that he was going to kill us both and then kill himself.” Michael Sanders’ voice shook, too – with agitation as he painted himself the dutiful husband and father. A victim, really, of a vengeful wife who in October filed for divorce. “She took my daughter and disappeared and I have not seen my daughter since t ...

Kilby files challenge to indictment Lowanda “Peanut” Kilby has filed two motions challenging her 60-felony count indictment in Rabun County Superior Court related to the Boggs Mountain Animal Shelter investigation. Toccoa lawyer Tim Healy filed a motion seeking to suppress comments Kilby made in front of investigators and another challenging the wording of the indictment. Kilby, 52, is charged with 29 counts each of theft by taking and computer theft and single counts of theft by deception and a violation of the Georgia and Racketeer Influenced Corrupt Organizations Act. She remains free on $100,000 bond. Kilby is the former director of Boggs Mountain Humane Shelter who transferred more than $10,000 intended for the shelter into her own accounts, according to court records. The indictment alleges the thefts took place from Dec. 12, 2011, and July 14, 2012. She resigned in the weeks after a television news story about irregularities with the Lucky Dog/Lucky Kitty program at the shelter. Healy argues in ...
Please, please we all know this story how Dr. Sinha was murdered in the street in front of his wife & 2 children. I am asking all of you to attend these final days. We as a community cannot stand by & do nothing. If the judge does not feel our outrage by our presence & he lets them off with minimum sentencing, what message will be sent to other youths in our communities. We the people of Old Bridge, Sayreville, Marlboro & Jackson must help & stand up! This whole trial has been an outrage. 3 years to get to a murder trial while other trials took only 6 months.
