Repeal of DOMA has created a problem in the 30 states that don't recognize same-sex marriages from other states and have state income tax. Assuming that at least one same-sex couple in each state has married legally elsewhere else, there is a tax fling status to figure out. Most, if not all, states require you to file taxes with the same status (single, married, married filing singly) that you use on federal forms. In those states where same-sex marriages are recognized, tax laws were adjusted to allow married couples who had no option but filing as single for federal returns to be able to file jointly for state taxes. If you are a tax official in a state with a law or constitutional amendment that does not accept the reality of married same-sex couples, how do you handle tax forms from the federal government that say the couple is married when the state says they cannot be? You c ...
What does yesterday's Supreme Court ruling REALLY mean? The Supreme Court, You and Me, and the Future of Marriage by Sherif Girgis, Ryan T. Anderson and Robert P. George What happened yesterday at the courthouse matters, and we must keep up our witness to the truth about marriage, by word and deed, until it is safely beyond judicial overreach. Here's the least reported fact about yesterday's rulings on marriage: the Supreme Court refused to give Ted Olson and David Boies, the lawyers suing to overturn Prop 8, what they wanted. The Court refused to redefine marriage for the entire nation. The Court refused to "discover" a constitutional right to same-sex marriage. Citizens and their elected representatives remain free to discuss, debate, and vote about marriage policy in all fifty states. Citizens and their elected representatives still have the right to define marriage in civil law as the union of one man and one woman. And we should continue doing so. Already, in the wake of yesterday's ruling, Governor ...

The “Kiss Kiss” singer was sentenced to five years probation, 180 days of community service and domestic violence counseling after pleading guilty to punching and beating singer Rihanna on the eve of the 2009 Grammy Awards in Los Angeles. Brown, also accused by prosecutors of having cut corners on his court-ordered community service, could be sent to prison if a judge decides that he has violated the terms of his probation, which is being handled by a Los Angeles County court. ...
Prop 8 does not go by-by. There are nuances that will not be felt for a few days... but I will quickly explain what I understand. In the California's constitution, the government *HAS TO* uphold a proposition (again, by law) until the prop is said to be unconstitutional by an upper court. The Supe's said they had no jurisdiction, and neither did the 9th circuit. The 9th vacated their position, and the ruling falls back down to the local judges ruling. Which means -- I believe -- that the judges ruling is only effective for the two couples suing, or that particular district? So what will happen? Jerry Brown has ordered -- unlawfully mind you, because prop 8 is still legal -- all 58 districts to start performing SSM. All it will take is one conservative county/attorney general to say no... and the case will again rise up to the echelons of SCOTUS (which has been making some good choices as of late). Except this time it will be in the Courts Jurisdiction because you will have a defense and a prosecution on i ...
SOCIAL WORKER GETS 90 DAYS FOR MOLESTING TEEN BOYS _ Palos Verdes Estates man gets 90 days for molesting teen boys Source: Daily Breeze, Jun 26 2013, 8:20pm CDT A retired social worker was ordered Wednesday to spend 90 days in jail and register as a sex offender for molesting teenage boys who lived in his Palos Verdes Peninsula homes, a sentence his victims said was not harsh enough. Martin Barry Canter, 63, will surrender July 5 at the Torrance Police Department jail to begin serving his sentence under the agency's Pay to Stay Inmate Worker Program. Avoiding county jail, Canter will pay $99 a day for his stay -- $8,910 -- but will be required to complete the entire three months. Had he been ordered to serve his time in county jail, Canter likely would have served less time because of jail overcrowding. Safety also was Martin Canter in Torrance Superior Court during his sentencing for committing sex crimes with boys living in his home. June 26, 2013. Probably gonna be another long one here, but will again be hopefully interesting and informative. The Supreme Court today ruled in two very highly anticipated same sex marriage cases, laying down some strong language and establishing precedent (!) in one of them. I'll start with United States v. Windsor (aka the DOMA case), then I'll go over Hollingsworth v. Perry (aka the Prop 8 case), before finally covering, Reuben Treatman, the Voting Rights Act case, Shelby Co. v. Holder, from yesterday. I'll go over what they mean and what may happen as a result of their holdings, and I'll give you a full, but concise, rundown of Shelby Co. As you may have heard, the Windsor case struck down a key provision of the federal Defense of Marriage Act, section 3, which covers the definition of marriage for all federal purposes (Social Security benefits, joint filing of taxes, bankruptcy protection, and the issue of this case, the federal estate tax). The case came down to a 5-4 vote with Justice Anthony Kennedy writing th ...

On July 8, 2013 Attorney Katlyn Draper will be sworn in as one of my assistant clerks. She is the first assistant clerk I have hired in seven years. There were 300 applicants for the position. In this post Probation Department hiring scandal era, I am proud to say that I followed the new hiring procedures of the Trial Court to a tee. There were five finalists who were all outstanding and worthy of the position. They were submitted to me by an interview panel comprised of a Justice of the Superior Court, a prominent attorney and an assistant clerk. What will surprise most people is that I had never met any of the finalists until they came in for their final interviews. Attorney Draper will be coming over from the Middlesex County District Attorney's Office. She is lead prosecutor for that office's child abuse unit. She has been the lead prosecutor in many high profile cases in recent years. Attorney Draper is a graduate of Providence College, the New England School of Law and lives in Beverly MA.
Scalia’s hypocrisy would only have been more amazing if the two rulings had come out immediately after one another instead of a whole day apart.
Parks After Dark Program Is On Posted on Jun 21, 2013 in Top Stories by adminComments Off Playing basketball or football or simply running around in a neighborhood park past sunset in the warm, lazy days of summer is an essential part of vacation. To continue that tradition, the Los Angeles County Department of Parks and Recreation, in partnership with the Department of Public Health, has extended the nighttime hours at six Los Angeles County parks three times a week until 10 p.m. This means, the lights will be on, organized sports will be played, free concerts and movies will be offered on Thursday, Friday and Saturday evenings from 6 p.m. to 10 p.m. through August 17. These longer hours have benefited coaches like Calvin Wortham, whose organization, Working with Youth, keeps youngsters off the street and on the basketball court or football or baseball fields. Wortham, who coaches at Jesse Owens Community Regional Park, said the longer hours have drawn neighborhood kids out to play and away from trouble. ...

Click image to see more photos. (Noah Berger/AP Photo) The Supreme Court released two major decisions expanding *** rights across the country on Wednesday as hordes of cheering demonstrators greeted the news outside. The justices struck down a federal law barring the recognition of same-sex marriage in a split decision, ruling that the law violates the rights of *** and *** and intrudes into states' rights to define and regulate marriage. The court also dismissed a case involving California's *** marriage ban, ruling that supporters of the ban did not have the legal standing, or right, to appeal a lower court's decision striking down Proposition 8 as discriminatory. The decision clears the way for *** marriage to again be legal in the nation's most populous state, even though the justices did not address the broader legal argument that *** people have a fundamental right to marriage. The twin decisions throw the fight over *** marriage back to the states, because the court ruled the federal governme ...
For anyone confused, this is what happened today. A very short version, mind you! In a nutshell, DOMA, Sect 3 is dead. This means couples who are already legally married and who live in a state that recognizes that marriage will now qualify for federal benefits. It's possible that for SOME federal benefits it won't be necessary for your home state to recognize your marriage. That's a complex issue requiring more explanation. The ruling did NOT establish a right to marriage across the country. In Prop 8, the Court said that the people who put the proposition on the ballot did not have a right to appeal Judge Walker's district court decision, so the 9th Circuit opinion has to be vacated (thrown out) and Judge Walker's decision stands. Gov. Brown has made it clear that as soon as the 9th Circuit lifts the current stay, all county clerks will be required to issue marriage licenses to same sex couples. This will probably be in about a month.
Today I made a suggestion to my congresswoman, both senators, and the NAACP. Since the court vacated Section 4 of the VRA, but not Section 5, Congress can replace Section 4. But I don't believe it could pass this Congress. So I suggested a replacement I think can pass: Apply the same standards to everybody--every county in all 50 states. Let the DOJ overturn any law or any gerrymandered district anywhere that will cause discrimination. It conforms to the SCOTUS decision, it's fair, and I think the GOP would have a real hard time arguing against it.
BREAKING: Iowa Supreme Court Will Reconsider "Irresistible Attraction" Case On June 24, the Iowa Supreme Court granted Melissa Nelson's request for rehearing in her case against James Knight, DDS. Melissa was fired by Dr. Knight on January 4, 2010, after more than 10 years of faithful service. Dr. Knight told Melissa she had done nothing wrong and that she was the best dental assistant he ever had. Unfortunately, Dr. Knight had become sexually attracted to Melissa and found her to be so irresistible that the only way to "protect his marriage" was to fire her. Melissa filed a complaint with the Iowa Civil Rights Commission alleging sex discrimination and filed a lawsuit against Dr. Knight on August 12, 2010. On November 7, 2011, the Iowa District Court for Webster County granted Dr. Knight's motion for summary judgment, throwing out Melissa's case before she ever had a chance to present her case to a jury. Melissa appealed the District Court's decision to the Iowa Supreme Court, which issued an opinion on ...
As reported previously, the corruption trial of Village of Monticello Trustee TC Hutchins has been suspended pending the court's findings in regard to a motion for mistrial by defense attorney Michael McDermott stemming from the revelation by Sullivan County District Attorney Jim Farrell of a previously unknown "secret" recording relevant to the case against Hutchins. Farrell has asked that the recording - obtained secretly by retired village Detective Luis Feliciano - of a conversation between himself and village resident Tommy Mack. The conversation stemmed from Feliciano's background investigation of former village police officer candidate Kariem McCline. Sullivan County Court Judge Frank LaBuda ordered the trial suspended early last Thursday, citing that "the trial cannot go on until this matter is resolved." Sources inside the court have indicated that a decision has yet to be reached by the court as of this writing, and a decision is not expected by tomorrow either. "Right now it's just a huge amo . ...
THIS JUST IN. - - MIS-REPORTING Nationwide taking place says General Counsel. "BREAKING NEWS: WASHINGTON D.C. U.S. Supreme Court Announces Decision on Prop 8 Just moments ago, the U.S. Supreme Court announced its decision in the Proposition 8 case. It is widely being mis-reported that the Court ruled against Prop 8. IT DID NOT! Rather, the Court said it could not reach a decision because California government officials refused to defend the law. So it did not rule on Prop 8's validity. In doing so, the Court also nullified the Ninth Circuit's ruling against Prop 8, which is a great victory in itself! So, the voter-passed Constitutional Amendment to protect man-woman marriage remains the law of the land in California, because only an appellate court can strike down a voter proposition statewide. But it remains to be seen what California officials will do now. Right now we are heading down the steps of the Supreme Court building to a long bank of TV cameras and reporters, to deliver this statement: “We ar ...
From California Att Gen Kamala Harris... we conclude that the injunction would apply statewide to all 58 counties, and effectively reinstate the ruling of the court...We further conclude that DPH(Dept of Health) can and should instruct county officials that when the district court's injunction goes into effect, they must resume issuing marriage licenses to and recording the marriages of same-sex couples...
From the Rockwall County District Attorney's office: Law Enforcement agencies from across Rockwall County will conduct a “No Refusal Program” during the July 4th holiday week. This is a program whereby a warrant will be sought to draw an individual’s blood for analysis if an officer has probable cause to believe that individual has been driving while intoxicated and he/she has refused to consensually provide a breath or blood sample. This is the fifth year that Rockwall County has conducted the program which will extend from 12:01 a.m. Friday, June 28th until 5:00 p.m. Monday, July 8th. Efforts are again being coordinated on a number of fronts. Lake Pointe Medical Center and Texas Health Presbyterian Hospital Rockwall have agreed to provide trained phlebotomists to draw blood at the hospital throughout the weekend. Rockwall County Court at Law Judge Brian Williams, McLendon-Chisholm Municipal Judge Andrew Leonie, and Royse City Municipal Judge Paul Liston will work in shifts to review and consider t ...

And here is the full opinion of the Voting Rights Act of 1965. Again, read this one carefully:
So can someone explain how not ruling on prop 8 affects it? My lay person understanding would lead me to conclude otherwise? Gina? Thomas?
I think todays ruling on the Defense of Marriage Act will rank right there with Brown vs. Board of Education.

Interesting that Republican majority States are taking advantage of The Voting Rights Act new ruling and Those States that re-elected our President by 126 Electoral College Votes and a significant majority of The Popular Vote, see the ruling as a step backwards and a horrific violation of "Legislation from The Bench"! I unfortunately see a march in the South in the near future.
First, this is quite possibly the best quote from Scalia's dissent in the DOMA case - "But the Court has cheated both sides, robbing the winners of an honest victory, and the losers of the peace that comes from a fair defeat." Now the second question, (admitting in advance that I've not read the Windsor opinion in total), from the snippets I've read from Kennedy's majority opinion, he frequently chastises Congress for putting traditional marriage above all else. Setting aside momentarily that he's fully eviscerated state's rights in this opinion, my question for all is as follows: In light of this opinion, how can we make polygamy illegal? In the same manner that equality doesn't end at black and white, but extends to all, so too must this decision. So to my many "equal sign" friends, I will pose the question this way: Will you go to your legislators and support your state allowing polygamy (a practice which has significantly greater historical underpinning than same-sex marriage). Or for that matte ...

From a good friend: "Happy with today's SCOTUS outcomes, but unhappy with the reasoning. From what I understand in reading the opinions so far, the majority opinion in U.S. v Windsor fails to firmly establish *** as a de facto protected class whose rights are worthy of elevated scrutiny under the Equal Protection Clause of the Constitution, and pretty firmly entrenches control over the the definition of marriage in state's hands. Rather, the decision merely implies that laws that are passed based on improper animus require heightened scrutiny (which DOMA clearly was) - potentially allowing state law makers to hide the ball by pretending there are other non-animus issues behind *** marriage-prohibition laws. This means to me that states will continue to have the ability to deny *** the right to marry without worrying about whether such denial violates the federal Constitution. Contrary to the state's rights slant of U.S. v. Windsor (DOMA), Hollingsworth v. Perry (Prop says that State's don't have control . ...
New England Patriots star tight end Aaron Hernandez was arrested Wednesday morning, more than a week after a body was found near his home in Massachusetts. Hernandez, 23, was placed in handcuffs and put in a police cruiser just before 9 a.m. on Wednesday by Massachusetts State Police and North Attleborough police. Authorities have searched his home, on the Rhode Island line not far from the Patriots' stadium, several times over the past week. Formal charges have not yet been filed. It was unclear why Hernandez was taken into custody. Bristol County District Attorney Samuel Sutter confirmed in a statement that Hernandez would be arraigned later Wednesday at Attleboro District Court. Advertise | AdChoices Less than two hours after the arrest, the Patriots announced they were releasing Hernandez. County OKs part of Skidmore’s legal bill By BRENDA BARBOSA STAFF WRITER Charlotte County commissioners agreed to advance an additional $20,000 for former commissioner Robert Skidmore’s legal fees in connection with a federal lawsuit filed by a former employee alleging sexual harassment and gender discrimination. Last year, Shonna Jenkins, a former code enforcement official, filed an 18-page complaint in U.S. District Court of the Middle District of Florida against Skidmore and the county alleging Skidmore harassed her with sexual innuendo, overt sexual comments and propositions while he served on the commission. Last year, commissioners agreed to front Skidmore $10,000 for his defense, arguing it was in the public’s best interest that he have legal representation since the county stands to lose a lot of money should Jenkins prevail. “We are tied at the hip on this,” County Attorney Janette Knowlton told commissioners Tuesday at a regular agenda meeting in the County Administration Building in Mu ...
Before we get too excited--let's clarify. Striking down DOMA is great. It never should have been signed in (remember the great liberal president Clinton signed it in). Second what happens to states that don't yet have *** marriage, even California, which didn't have it before Prop 8, only in a few places? Finally what about people who have partners from other countries? I thought that was federally determined--whether the foreign partner could be legal. If anyone can answer these questions please do.
Dog ordinance amendments get ‘do-pass’ By: Don Thomason - The Sentinel-Record Proposed amendments to the Garland County animal control ordinance to specifically regulate pit bulls was given a do-pass recommendation Monday night by the Garland County Quorum Court’s Animal Control Subcommittee. Dozens of concerned county residents and pit bull owners packed the meeting room at the Garland County Court House for the four-hour discussion of the revised county animal control ordinance. “We were giving everyone plenty of opportunity to give their piece of mind,” District 13 Justice of the Peace Mickey Gates said Tuesday. “Oftentimes, government fails best when it fails to listen, and obviously no one was going to walk away totally happy, but we were pleased with the results,” Gates said. The proposed amendments up for discussion included spaying and neutering; required that the dogs be kept indoors or confined when outdoors either by a tether or inside a chain-link fence that is at least 6 feet ta ...
Just hearing bits of news from the US SUPREME COURT as I enter Florence. Update me!
If anyone in the entire world foresaw Roberts, Scalia, Ginsburg, Breyer, and Kagan as the majority in the Prop 8 case, I salute you. What I can't make sense of is if there is no standing for those in support of traditional marriage, meaning no harm, yet there is standing for proponents of marriage equality, then how can there be even a rational purpose for upholding traditional marriage, if nobody is harmed by allowing marriage equality? And if an executive branch decides not to defend any law passed through legislative means, does that mean nobody else can defend the law? And if so, what's to stop interest groups from filing suits against laws that are politically unpopular according to the executive, and then allow those suits to be dropped simply because the executive doesn't want to pursue them? While this looks facially neutral, finding a lack of standing could open up the possibility of a mass influx of politicizing into the judicial process. Regardless, still an exciting day. HRC should keep promo ...
A serious question for black voters/activists: With news that DOMA is unconstitutional and rulings against the Voting Rights Act and affirmative action, do you feel your political power is slipping away?
The Supreme Court also today affirmed the stopped clock theory--it was right twice today (even if its reasons questionable).
BTW, this doesn't mean that same sex marriages can start happening immediately. The Supreme Court remanded the case with instructions to dismiss the appeal, which means there is some paperwork to finish before the order is final.
To be honest, I'm confused why the district court's ruling in _Perry_ would still have force, since the California officials also refused, at that stage, to defend the law (and, hence, the same private parties were defending the law in district court). Saalim Abdul Carter, Alexander Smart

There are hints in the DOMA dissent that Prop 8 case will be tossed on standing. So same-sex marriage will *likely* resume in California.

GINSBURG DISSENT TO THE REVISIONIST [QUASI/LEGISLATIVE] SCOTUS RIGHT WING CABAL OF 5. Here are five key excerpts from her dissent: "When confronting the most constitutionally invidious form of discrimination, and the most fundamental right in our democratic system, Congress' power to act is at its height." "Demand for a record of violations equivalent to the one earlier made would expose Congress to a catch-22. If the statute was working, there would be less evidence of discrimination, so opponents might argue that Congress should not be allowed to renew the statute. In contrast, if the statute was not working, there would be plenty of evidence of discrimination, but scant reason to renew a failed regulatory regime." "Just as buildings in California have a greater need to be earthquake proofed, places where there is greater racial polarization in voting have a greater need for prophylactic measures to prevent purposeful race discrimination." "Congress approached the 2006 reauthorization of the VRA with ...
