Bed rails are widely advertised as keeping elderly persons safe in bed, despite hundreds of people having died and thousands having been injured from these devices. Furthermore, little to no action has been taken by the Food and Drug Administration (FDA) and the Consumer Product Safety Commission (CPSC) on this important consumer safety issue. In fact, the two agencies disagree over which agency oversees the different kinds of bed rails. The Consumer Product Safety Commission announced Wednesday it filed an administrative complaint against Baby Matters, LLC, after discussions with the company and its representatives seeking a voluntary recall plan broke down. The recliners, manufactured by Baby Matters, LLC, based in Berwyn, Pennsylvania, include the Nap Nanny and Nap Nanny Chill infant models. The CPSC alleges parents who continue to use the products are putting their infants at significant risk of injury and death. Statistics from the government’s Consumer Product Safety Commission, which tracks injuries by product type, show children are getting hurt more during activities and at ages that would seem to warrant close supervision. Injuries involving playground equipment among children under five jumped 17% between 2007 and 2010, after trending down the previous five years, the commission said. Injuries involving nursery equipment such as changing tables were up 31% among children under five over that period, after declining over five years. Injuries involving swimming pools climbed 36% in that age group after a slight increase over the prior five years.
