The National Portal of India india.gov.in tells us that the song Vande Mataram has an equal status with Jana-gana-mana - our National Anthem. It further states ... 'On January 24, 1950, the President, Dr. Rajendra Prasad came up with a statement in the Constituent Assembly, "the song Vande Mataram, which has played a historic part in the struggle for Indian freedom, shall be honoured equally with Jana Gana Mana and shall have equal status with it."' Is it probably time we considered the possibility of moving to a new, more fitting anthem that was actually written for our country, instead of one that was allegedly written in praise of the Royal family of England?

Article 370 has played no less a part in preventing J&K from becoming an integral part of the Indian Union. Not many people are aware as how and why this Article was formulated and included in the Indian Constitution despite grave misgivings of Sardar Patel and indeed a large number of the members of Congress Working Committee and Constituent Assembly. Article 370 was worked out in late 1947 between Sheikh Abdullah, who had by then been appointed Prime Minister of J&K by the Maharaja and Nehru, who kept the Kashmir portfolio with himself and kept Sardar Patel, the home minister, away from his legitimate function. Hence Nehru is answerable to all acts of commission and omission, consequences of which we are suffering till date as far as J&K is concerned.
NEHRU'S CLEAR POLITICAL DRAMA on ARTICLE 370 BY MISUSING THE NAME OF SARADAR PATEL: Gopalaswamy Ayyangar has been especially asked to help in Kashmir matters. Both for this reason and because of his intimate knowledge and experience of Kashmir, he had to be given full latitude. I really do not know where the States Ministry (Sardar Patel’s ministry) comes into the picture except that it should be kept informed for the steps taken. All this was done at my instance and I do not propose to abdicate my functions in regard to matters for which I consider myself responsible. May I say that the manner of approach to Gopalaswamy was hardly in keeping with the courtesy due to a colleague.” It speaks volumes of Patel’s loyalty to a colleague that despite his own and others misgivings, he managed to convince the members of Constituent Assembly and Congress Party Executive. But to V Shankar he said “Jawaharlal Royega”. The Sardar thereupon resigned and the matter fell in Gandhiji’s lap to bring the two co ...

Learn About the Indian Flag What is a Flag? The word flag is of Teutonic (German) origin and probably came into use around the 15th and 16th centuries in various northern European languages signifying a piece of cloth, bunting or a similar material displaying the insignia of a community, an armed force, an office or an individual. A flag in a classical sense is usually, but not always oblong and attached to a staff or halyard. In the early days of history, the flags besides being objects of worship and reverence, also served as rallying points for organizing armies and for identification of friend and foe during battles. For this purpose flag bearers were used in wars to give direction to soldiers. History of the Indian Flag To select a flag for Independent India an ad hoc committee was created by the Constituent Assembly on 23 June 1947. The committee headed by Rajendra Prasad and included Maulana Abul Kalam Azad, Sarojini Naidu, C. Rajagopalachari, K. M. Munshi and B.R. Ambedkar as its members. The comm ...

Omar Abdullah says either Article 370 stays or Kasmir will not be with India. And then he quotes some innuendos about Constituent Assembly to justify his stand. By the way, if it matters to anyone, Article 370 was vehemently opposed by BR Ambedkar, a key member of the constituent assembly. Ambedkar's resistance to Sheikh Abdullah regarding article 370 was - you want India to protect your borders, you want Indian soldiers to die for you, you want India to build roads, other infrastructure for you but the govt of India should have limited or no power and Indian people to have no rights. Ambedkar refused to be part of article 370. It was only because Nehru had given a promise to Sheikh Abdullah for article 370, Sardar Patel helped pass the article 370. No wonder Omar Abdullah considers Kashmir to be his ancestral property. After all it was gifted to his father by his father and God only knows why Nehru had to promise special status to Sheikh Abdullah.
Mr. Omar Abdullah has dared, challenged and criticised the abrogation of Article 370. May I remind Mr. Omar Abdullah and his father Mr. Farooq Abdullah that they were appointed only as INTERIM caretakers of the state of Kashmir. Mr. Omar Abdullah's ancestor - Mr. Sheikh Mohammed Abdullah, the founder of National Congress (NC) was pardoned by the then Ruler of Kashmir - Maharaja Hari Singh and made him the 'INTERIM' caretaker of the princley state of Kashmir during the accession of Kashmir and till the Constituent Assembly was formed. Mr. Sheikh Abdullah wrote a letter dated 26 September 1947 seeking pardon from Maharaja Hari SIngh and I quote, " Inspite of what has happened in the past, I assure Your Highness that myself and my party have never harboured any sentiment of disloyalty towards Your Highness's person, throne or dynasty...I assure Your Highness the fullest and loyal support of myself and my organisation...Before I close this letter I beg to assure your Highness once again of my steadfast loyalt ...
Background and election The Constituent Assembly was set up while India was still under British rule, following negotiations between Indian leaders and members of the 1946 Cabinet Mission to India from the United Kingdom. The provincial assembly elections had been conducted early in 1946. The Constituent Assembly members were elected to it indirectly by the members of these newly elected provincial assemblies, and initially included representatives for those provinces which came to form part of Pakistan, some of which are now within Bangladesh. The Constituent Assembly had 299 representatives, including nine women. The Interim Government of India was formed on 2 September 1946 from the newly elected Constituent Assembly. The Congress held a large majority in the Assembly, with 69 percent of all of the seats, while the Muslim League held almost all of the seats reserved in the Assembly for Muslims. There were also some members from smaller parties, such as the Scheduled Caste Federation, the Communist Part ...

From The Hindu Newspaper- Understanding Article 370 Article 370 was and is about providing space, in matters of governance, to the people of a State who felt deeply vulnerable about their identity and insecure about the future. At the Bharatiya Janata Party’s recent Lalkar rally in Jammu, its Prime Ministerial candidate, Narendra Modi, called for a debate on Article 370. This is encouraging and suggests that the BJP may be willing to review its absolutist stance on the Article that defines the provisions of the Constitution of India with respect to Jammu and Kashmir. Any meaningful debate on Article 370 must, however, separate myth from reality and fact from fiction. My purpose here is to respond to the five main questions that have already been raised in the incipient debate. Why it was incorporated First, why was Article 370 inserted in the Constitution? Or as the great poet and thinker, Maulana Hasrat Mohini, asked in the Constituent Assembly on October 17, 1949: “Why this discrimination please?” ...
1.With reference to Indian History, the Members of the Constituent Assembly from the Provinces were (a) directly elected by the people of those Provinces (b) nominated by the Indian National Congress and the Muslim League (c) elected by the Provincial Legislative Assemblies (d) selected by the Government for their expertise in constitutional matters
An insightful comment regarding the modi wave. Stop the poojas - let the man do his job. We have been hearing the slogan, Modi is India and India is Modi?? I would like to draw the reader's attention to what Ambedkar had warned against. He believed bhakti in politics is fatal. In his remarkable last speech to the Constituent Assembly (which all Indians, and all democrats, should read) he said that while bhakti in religion may be a road to the salvation of the soul, in politics, bhakti or hero-worship is a sure road to degradation and to eventual dictatorship. Ambedkar was prophetic. During Indira Gandhi's regime, Congress President D K Barooah coined the phrase 'Indira is India'. The sycophancy around Indira encouraged her to centralise power in herself and in the end promulgate the Emergency. The bhakti around Mahatma Gandhi was wrong too. For one thing, an excessively worshipful attitude prevents us seeing him as a great leader who was also flawed and may deter us from learning from his flaws. In India ...

The search for Jinnah's vision of Pakistan Sixty-five years after the death of its founding father, Pakistanis are still searching for Mohammed Ali Jinnah's vision for the country - and a missing historical speech. During much of its existence, Pakistanis have been encouraged to believe that Mr Jinnah created Pakistan in the name of Islam as a theocratic state. Others have disagreed, arguing the founding father wanted a Muslim-majority but secular and progressive country. The debate over the two competing and contradictory visions has intensified in recent years as the country reels from growing Islamic extremism and Taliban militancy. At the heart of this debate are some public addresses of Mr Jinnah given around the time of the partition of India in 1947. . The archives of state-owned broadcaster, Radio Pakistan, also contain cranky old audio recordings of most of those speeches, except for one: his address to the Constituent Assembly in the port city of Karachi on 11 August 1947, three days before the ...

EXCERPTS OF SPEECH OF DR. B. R. AMBEDKAR DELIVERED AT THE TIME OF INTRODUCING Draft Constitution ON NOVEMBER 04th 1948, ON THE ISSUE OF SAFEGUARD TO MINORITIES. "The Draft Constitution is also criticised because of the safeguards it provides for minorities. In this, the Drafting Committee has no responsibility. It follows the decisions of the Constituent Assembly. Speaking for myself, I have no doubt that the Constituent Assembly has done wisely in providing such safeguards for minorities as it has done. In this country both the minorities and the majorities have followed a wrong path. It is wrong for the majority to deny the existence of minorities. It is equally wrong for the minorities to perpetuate themselves. A solution must be found which will serve a double purpose. It must recognize the existence of the minorities to start with. It must also be such that it will enable majorities and minorities to merge someday into one. The solution proposed by the Constituent Assembly is to be welcomed because i ...

Tundu Lissu Renowed lawyer, Prof Issa Shivji has been faulted by several of his colleagues of the Constituent Assembly for allegedly advocating a two tire government structure a move they say is against what he stands for and also contravenes his various publications regarding the Union. The criticism follows his remarks made on Sunday while presenting a paper at the National Youth Symposium held in Dar es Salaam where he is quoted as having said ‘if the constituent assembly will endorse the proposed Draft Constitution without any changes, there will be no Union.’ Speaking in a press conference yesterday in Dodoma, Tundu Lissu said the veteran legal expert has recanted what he seemed to stand for in his previous publications: ‘Africanism or Pragmatism’ and ‘Tanzania: The Legal Foundation of the Union’. Lissu further said in Prof Shivji’s publication of 2008, the legal expert wrote that the Union was not agreed upon by both sides and it was on that ground he has been arguing against it. “I ...

Colonized by Spain in 1522, Venezuela became one of the first Spanish American colonies to declare independence in 1811. During the 19thcentury, Venezuela suffered political turmoil and dictatorship and until well into the 20th century it was dominated by regional military strongmen. However, since 1958, Venezuela has had democratic governments. The economic upheavals of the 1980’s and 1990’s led to a political turmoil in Venezuela, with hundreds of deaths in the 1989 Caracazo riots; two attempted coups in 1992; and, the impeachment of President Carlos Andrés Pérez for embezzlement of public funds in 1993. The 1998 saw the election of former career officer, Hugo Chávez, as President and the launch of the Bolivarian Revolution, beginning with a 1999 Constituent Assembly to write a new Constitution of Venezuela. After the death of Hugo Chávez in 2013, Nicolás Maduro Moros was elected President of Venezuela on April 14, 2013. Nicolás Maduro, the former bus driver/union leader, was elected to the .. ...

Special features Separate Constitution J&K is own. The Constitution of J&K was enacted by a separate Constituent Assembly set up by the State and it came into force on 26 January 1957. Jurisdiction of Parliament Union Legislature has very limited jurisdiction in case of J&K as compared to other states. Till 1963, Parliament could legislate on subjects contained in the Union List, and had no jurisdiction in case of Concurrent List under 7th Schedrest with J&K. The Parliament has no power to legislate Preventive Detention laws for the state; only the state legislature has the power to do so.
Amendment of Article 370 Under Article 370, consent of state legislature and the constituent assembly of the state are also required to amend Article 370. Now the question arises, how can we amend Article 370 when the Constituent Assembly of the state no longer exists? Or whether it can be amended at all? Some jurists say it can be amended by an amendment Act under Article 368 of the Constitution and the amendment extended under Article 370. But it is still a mooted question.

.National Anthem of India. National Anthem can be described as a patriotic musical composition of a country, which reminds and praises the history, traditions and struggles of its people. At the same time, it has to be recognized as the official national song, either by the nation's government or by convention through use by the people. The National Anthem of India is 'Jana-gana-mana', composed originally in Bengali, by Rabindranath Tagore. It was adopted as the National Anthem of India, in its Hindi version, by the Constituent Assembly, on 24th January 1950. 'Jana-gana-mana' was first sung on 27th December 1911, long before Indian gained independence, at the Calcutta Session of the Indian National Congress. The complete song consists of five stanzas. As for the playing time of the full version of the National Anthem, it will take up approximately 52 seconds. A short version, consisting of first and last lines of the stanza (playing time approximately 20 seconds), is also played on certain occasions. Nati ...

MUSEVENI'S JATT TERRORISES UGANDA As the NRA became deeply engaged in the Congo, the ADF suspended its field combat operations. Instead it focussed on urban terrorism. Several incidents of explosive attacks using Improvised Explosive Devices (IEDs) were witnessed. Tumukunde who had been the NRA's Chief of Personnel and Administration (CPA) was appointed the new Director of Military Intelligence (DMI). To retain the title of Chief, he renamed the DMI as Chieftancy of Military Intelligence (CMI). Among his immediate tasks was to tackle the explosions in Kampala. This was a matter that would have been handled by ISO and the regular Police because it fell under internal security. Museveni who prefers a militaristic approach to all aspects of public management, fully facilitated CMI to take over as the lead state Intelligence agency. With all the resources at Tumukunde's disposal, he built capacity to break into the network of the ADF urban Hit Squad. Using the vast amount of financil resources, ADF operatives ...
On 12 March 1949, the first constituent assembly of Pakistan passed the Objectives Resolution which was proposed by the first Prime Minister Liaquat Ali Khan, proclaimed that the future constitution of Pakistan would not be modeled entirely on a European pattern, but on the ideology and democratic faith of Islam. The legislative elections in 1954 saw the Awami League coming to power and its leader Huseyn Suhrawardy becoming country's first Bengali Prime Minister. Promulgation of Constitution in 1956 lead to Pakistan declaring itself Islamic republic (official name) with the adoption of parliamentary democratic system of government. The constitution transformed the Governor-General of Pakistan into President of Pakistan (as head of state). Subsequently, Iskander Mirza became the first president as well as first Bengali in 1956, but the democratic system was stalled after President Mirza imposed the military coup d'état and appointed Ayub Khan as an enforcer of martial law.

Quota for Muslim Professors in HR & CE Governed College – Unconstitutional move by TN Govt. Electioneering is an important component of a healthy democracy. World over, political parties and politicians conduct their election campaigns by showcasing their past achievements and vision documents for the future. They will focus on the entire electorate. Whereas in India, most of the political parties and politicians focus on bogus secularism with the only intention of winning over minorities wooing them with promises and schemes which mostly end up as detrimental to the majority community. Such an outrageous act, al a Aurangazeb, has been committed by the Tamil Nadu Government. The Tamil Nadu Government has allocated exclusive quota for Muslims for the post of Assistant Professors in Arulmigu Palaniandavar College of Arts and Culture. Just posted this at Andrew Bolt's Blog; sending it in as a letter too (Probably no hope of being published though :-( ): For Andrew: You're entitled to your opinion as a Conservative to oppose Marxism, or Leftism in general - but get your facts straight. In the 19th Century Social Democratic - that is Marxist - parties were at the very forefront of the struggle for free, universal and equal suffrage in Europe. What is more, when the Marxist Left split during the 1914-1919 period Social Democratic Marxists opposed the Great War bloodbath; but also opposed the new 'Communism' as espoused by the Bolsheviks in Russia. Specifically, they resolutely opposed over-centralisation, one party dictatorship, militarisation of labour, the suppression of civil liberties, and the dissolution of the Russian constituent assembly. That said, the Bolsheviks do deserve recognition that they governed under extreme circumstances of war, social break-down and starvation. But the Marxist Social Democrats understood the d ...
Kamran, I am liberal and don't care what religion other people have but this is not right that Mr Gandhi taught us humanity. Mr Gandhi took the nonviolence philosophy from Jesus Christ and Ahinsa (non-violence) from Hindu scriptures. No Pakhtoon has, nor accepted it that time neither will accept it now because it has nothing to do with their culture and traditions. May be Gandhi was a great leader for Indians but the damage and enmity he extended to the Pakhtoons in the garb of friendship, has no example in the history of mankind. Bacha Khan was a sincere and honest soul and he, not only believed but practically did what Mr Gandhi told him and followed him blindly. Instead that Bacha Khan dealt with the problems of the Pakhtoon nation with British himself he gave Mr Gandhi all the powers of a Mukhtar-i-Aam (General Power of attorney) with which he could sell us Pakhtoons to anybody, to whom he wanted and he sold us to Pakistan. Mr Gandhi didn't demand the British on behalf of Bacha Khan that Pakhtoonkhwa ...
Our freedom, their control ‘Is There Anybody There’ To Enlighten Us? nandalal chakrabarti SIR Harold Wilson in his Nehru Memorial lecture on 2 November 1978 recounted a highly intriguing event concerning India’s decision to retain the membership of the Commonwealth even after becoming a Republic. Prime Minister Attlee informed the King and cautiously broached the subject to the leader of the Opposition, Sir Winston Churchill. “While fully agreeing that it was most important not to weaken the link of the allegiance to the Crown, Churchill thought it should be possible to retain a republican India in the Commonwealth.” After consulting his colleagues, he gave his full support to Attlee. One does not have to read too much between the lines to find out the most important condition of Churchill’s acceptance of the proposal. It was a pledge not to weaken the allegiance to the Crown. Wilson projected Sir Winston’s consent as the ultimate vindication of what Nehru stood for, i.e. a continuation of l ...

Libyan Prime Minister Ali Zeidan has denied reports about a military coup in Libya. "There is no coup," Zeidan said in a speech aired on the Libyan television on Friday. "There will be no return to the era of coups," he said. Military commander Maj. Gen. Khalifa Haftar earlier claimed that his forces have seized control of several military and vital sites in the country. Haftar alleged that his forces have suspended the General National Congress (interim parliament) and the government. But Zeidan insisted that Libyan security agencies are in full control of the situation on the ground. He went on to say that he has given orders to the Defense Ministry to "take all necessary measures" against Haftar, calling for public support for the government and GNC "to cruise the country to safety". Libya has fallen into a political crisis since the GNC voted to extend by one year both its mandate and the country's transitional period, which followed the fall of Muammar Gaddafi in late 2011. The Constituent Assembly met for the first time in New Delhi on 9 December, 1946 in the Constitution Hall which is now known as the Central Hall of Parliament House. Overwhelmed and jubilant as they were, the hon'ble members sat in semi-circular rows facing the Presidential dias. The desks which could be warmed electrically were placed on sloping green-carpeted terraces. According to the constitutional mandate, the formation of the consensus-based government would be given first priority. Ranga, member of the Swatantra Party, stood in front of the Constituent Assembly and argued that any affirmative action should only be on the lines of economic status and not caste. He said if caste-based affirmative action is implemented, we shall never be able to do away with Castetisism. Ranga's voice of dissent was hushed. Do not let Dwivedi's meet the same fate.

The delegation also met with Pople Tawadros II on Sunday and the Pope explained the nature of the events in Egypt. State-run Al-Ahram cited the Pope as describing the events of 30 June as a revolution, not a coup. Former presidential candidate and former chairman of the Constituent Assembly, Amr Moussa, also held talks with the delegation ...
Why was Article 370 included in the Constitution? After introduction of the motion in Constituent Assembly, the member from Bihar in the Constituent Assembly Maulana Hasrat Mohani asked the question: Why this discrimination? Gopala Swami Ayangar replied: In Kashmir there are some special circumstances; so certain special arrangements are required there. He further explained thus: (1) A war is going on in Jammu & Kashmir state. There is cease-fire but the situation is still not normal. (2) A part of the state is still under occupation of invaders. (3) We are still engaged in UNO. The solution of Kashmir problem remains pending. (4) Government of India has promised Jammu & Kashmir people that a final decision would be taken according to the wishes of local people only after normalization of the situation there. (5) Praja Sabha is not in existence now. We have accepted that the scope of Union Constitution with regard to the state would be decided separately by the State Constituent Assembly. 26th January, India’s Republic Day Many Indians remain largely unfamiliar with the anniversary that Indians celebrate on 26th January. For most Indians the day has lost its meaning and value. It has become just another day not to go to work or to school. While paying tribute to one of the most important dates on the Indian calendar I take this opportunity to explain the meaning and importance of 26th January, i.e. Republic Day. The Indian Independence Act, 1947, provided that as from the 15th August, 1947 in place of ‘INDIA’ there would be set-up two independent Dominions to be known as India and Pakistan. The Constituent Assembly of each Dominion was to have unlimited power to frame and adopt any Constitution and to repeal any Act of British Parliament. The Constituent Assembly of India started the work of drafting a Constitution for India. It appointed various sub-committees. The salient principles of the proposed Constitution were outlined by the various sub-committees of the Assembly. After a ge ...

Nepal court says no need to elect new president AP | Jan 24, 2014, 10.20 AM IST KATMANDU, Nepal: Nepal's top court has ruled that there is no need to elect a new president, settling a major point of differences among the political parties. Supreme Court spokesman Shree Kanta Poudel said the judge ruled late Thursday that a new president should be elected only after the new constitution has been promulgated. Ram Baran Yadav was elected the first president in 2008 after the centuries-old monarchy was abolished and Nepal turned into a republic. It was initially thought Yadav would be in office for two years but has remained as president for more than five. The last Constituent Assembly failed to complete the task of writing a constitution and a new one elected in November assumed duty this week.

Constituent Assembly continues vote on constitution articles
India was ruled by British directly on the territory falling within British India - through the offices of Governor General and Governors and indirectly by exercise of Paramountcy over princes in the States namely Hyderabad, Mysore, J & K, Gwalior, Travancore etc. The British Parliament enacted the law namely Indian Independence Act, 1947, transferring the sovereignty of British India to the Indian Constituent Assembly and Pakistan Constituent Assembly. On princely States, British did not transfer their power of Paramountcy to Constituent Assemblies of either India or Pakistan, but simply terminated the power [S/7(2)] leaving princes free to do what they desired in their best interest. Since princes had no Army to defend their territories (as British did not permit them to raise forces), they quickly signed instrument of accession and joined India and Pakistan depending on contiguity. Some princes initially resisted accession and tried to stay free as separate nations namely Travancore and Bhopal. Problem ...
Lets have a debate on Article 370, says RSS senior functionary Arun Kumar ”Article 370 is nothing but an additional legalistic mechanism to make some laws when Constituent Assembly was not constituted in Jammu and Kashmir,” senior RSS leader Arun Kumar said at a seminar, “Article 370: Reality and Myths”, organized by Jammu and Kashmir Study Centre in Jammu on Wednesday. “Article 370 is a temporary arrangement but ruling parties have been abusing this Article to accomplish t...heir personal agenda,” he alleged. He said it was high time to take this issue to a logical conclusion because the people of Jammu and Kashmir have suffered a lot due to this Article. Maintaining that Jammu and Kashmir has been “mis-quoted”, “mis-handled” and “mis-carried”, Kumar said nationalist forces all over the country have decided to take political discourse of the state by highlighting issues, which remained unheard due to vicious campaign of some forces of the Kashmir Valley. Speaking on the occasion, ...

“Free Health Camp for Uterine Prolapse” We at Care Women Nepal are going to mark the start of a new year by continuing our fight against the “silent tragedy” that is uterine prolapse. In order to do this we are going to organize a “Free Health Camp for Uterine Prolapse” on the 23rd and 24th of January, 2014 at Rajarani V.D.C. of Dhankuta district, with the technical support of Birat Hospital, Biratnagar. The event will be inaugurated by Dr. Shekhar Koirala, Senior Central Member of Nepal Congress, Constituent Assembly member and former Vice-Chancellor of B.P. Koirala Institute of Health Science, Dharan. Uterine prolapse is a major problem affecting the women of rural parts of Nepal as evidenced by the fact that Nepal accounts for the highest number of women suffering from uterine prolapse. An astonishing fact in itself but even more surprising is the attitude of the society towards the women suffering uterine prolapse. Rather than being supportive in such grave times, the society and family me ...

Part-2 Direndra Nath Dutta, a Bengali opposition member, moves a resolution in the first session of Pakistan's Constituent Assembly for recognizing Bengali as a state language along with Urdu and English. The resolution "... was opposed by Liakat Ali, the Prime Minister of Pakistan and other non-Bengali members in the Assembly. Regrettably, this was opposed by Khawaja Nazimuddin - hailing from the eastern wing - and a few other Bengali collaborators of the West Pakistanis in the Assembly. Later, D. N. Dutta came up with a few amendments to the original resolution, and everytime these were opposed by the west Pakistanis and their Bengali stooges. The West Pakistanis were uncompromising to such a genuine demand of the majority Bengalis." (-- Rafiqul Islam)

TUNIS: Debate on Tunisia's new constitution was suspended Sunday after a deputy claimed he had received death threats because a colleague accused him of being an "enemy of Islam". The outburst came a day after the National Constituent Assembly (NCA) adopted articles making Islam the state religion but guaranteeing freedom of conscience. Sunday's row broke out after Mongi Rahoui, from the left-wing Popular Front, accused Habib Ellouze of the Islamist ruling party Ennahda of saying he was an enemy of Islam. Such words are not taken lightly in Tunisia, where the suspected assassination by militant Salafist Muslims last year of two opposition politicians threw the country into a political crisis that has still not been resolved. A police source told AFP security measures for Rahoui had been stepped up from Saturday night because of the alleged threats. Addressing Ellouze, a hardline Ennahda member known for his controversial comments, Rahoui asked: "How much more blood must there be before we understand that ...

Oh Junagadh! Junagadh was one of the eight princely state in Kathiawar region of Gujarat Province. All the states had a Hindu majority and Hindu rulers except Junagadh which was ruled by a Muslim Nawab Mohammad Mohabat Khanji III. The partition plan stipulated that all contiguous Muslim majority areas will join Pakistan and all contiguous Hindu majority areas will join Bharat India. The 540 princely states where not part of this plan. For them the options were to either join India or Pakistan or to become independent. Under the partition plan the decision what the state will do was to be taken by the ruler who was urged to consider the will of the people but was not legally bound to ask the opinion of the people he/she ruled. Nehru and Congress leaders clearly declared that there was no question of any state becoming independent and they should either join Pakistan or India. Jinnah was rather more ambiguous and indicated that he was not averse to a state declaring independence. Did he do this with some ul ...

The idea of a constituent assembly to frame a constitution for a country was alien to the British imperial practice. It was demanded by INC in 1934. However, it was opposed by the Muslim League as it suspected that an elected Constituent Assembly would be dominated by the Congress which it considered as a Hindu party.
The way Proportional Constituent Assembly Members are chosen from various political parties, raise a serious questions. It not only undermined the democratic process but also lowered the dignity and seriously affected the sanctity of Constituent Assembly. If the Members of Constituent Assembly are the product of a corrupt and in transparent process, how can they produce a Constitution on which the nation can feel proud? The morning shows the day. In the very beginning, the Assembly is going to loose its credibility, respect and sanctity. The most unfortunate part is- our politicians never learn any lessons. Any suggestions on how - 'we the citizens' move forward ? What intervention citizens can make in this juncture? We must break the culture of silence and make a meaningful intervention. The money and mafia power should not allow to undermine people's power in democracy. The Citizen should not be remain only silent spectators. WHAT IS THE INSIDE STORY OF THE ITONGWA ARMED REBELLION? During the Constituent assembly the NRA was represented by Mugisha Muntu, David Tinyefuza, Aronda, Serwanga Lwanga, Elly Tumwine, and Noble mayombo among others. During the debate on controvercial issues especially Buganda's most cherished Federalism and the Presidential powers, Tinyefuza, Serwanga and Besigye had demonstrated the highest level of independence in their stands. To the NRA leadership which expected its delagates to tow the army line, this was a clear sign of subversiveness by the Gang of Three. Their stand stunned many delagates who did not know the internal contradictions inside Museveni's NRA. Aronda who was also the DMI and Museveni's closest confidant, was silent throughout the open debates on the floor of the House. But he ran a President's office at the adjacent International Conference Centre (ICC) that was manned by Susan Kazoora. Tunisia to Vote on New Charter 3 Years after Uprising Tunisia's National Constituent Assembly is to begin voting on the future constitution Friday, three years after the country's popular uprising and after five months of deadlock between the ruling Islamists and opposition. The adoption of Tunisia's constitution would represent a crucial milestone in the birthplace of the Arab Spring, where hopes of a successful democratic transition contrast starkly with other countries in the region rocked by regime change. But with revisions added after intense last-minute negotiations, a final draft had yet to be circulated two days before the scheduled scrutiny of the long-delayed charter, which is to be voted on article by article. Ennahda, the ruling Islamist party, said the text that was completed in June but rejected by the opposition will be submitted to MPs and will have an index detailing the revisions it thrashed out with the opposition in December.
Despite excess liquidity, depreciation of Nepali currency against US dollar, record high trade deficit and continuation of low performance in capital spending, the year 2013, has ended with a positive beginning. The successful Constituent Assembly (CA) election has rekindled confidence of the private sector. Surge in Nepal Stock Exchange (Nepse) index - one of the key barometers of the confidence of private sector -- indicates that 2014 will see positive economic developments. Though the government has made attempts to restore business confidence and shore up public spending, there is excess liquidity in banking system due to lack of new investment avenues and slow progress in capital expenditure. In the first five months of 2013/14, development expenditure reached 9.34 percent of the total allocated budget of Rs 85.1 billion. The deprecation of Nepali rupee against the greenback created both challenges and opportunities to Nepal. The fall in value of Indian currency, with which Nepali rupee is pegged, p ...
The year 2013 proved to be a good year for Nepal´s stock market. The Nepal Stock Exchange (Nepse) benchmark index gained 237 points over the year to close at 770. 9 on Wednesday- the last trading day of this year. Akin to the vibrancy seen during the first Constituent Assembly (CA) polls in 2008, the stock market regained the bullish trend this year as well with the successful polls for second CA. The index, which was moving at a snail´s pace due to political stagnation with the dissolution of the erstwhile Constituent Assembly, started climbing upward only in the last quarter of the year when the country headed toward the Constituent Assembly polls. Though the market was expected to get a boost with the formation of Khila Raj Regmi-led government, the Nepse did not respond the change of the guard in a positive note. The timely announcement of budget also failed to energize the stock investors. The index was hovering around 500 points when the new fiscal year (2013/14) began in mid-July. Though the poli ...
Nepal: Parties Back to their Old Ways Despite a Fresh Mandate: Update No. 290 Note No. 706 Dated 27-Dec-2013 By Dr. S.Chandrasekharan Despite a successful election with an overwhelming and peaceful participation of the people, the political parties have gone back to their old ways and no effort is being made to quickly convene the parliament and go ahead with the constitution making process. In one sense, nothing has changed and this is sad. After five weeks of negotiations, the High Level Political Committee that has been revived to placate some of the parties, reached a four-point agreement to go ahead with the political process. The points agreed to were: 1. A Parliamentary panel is to be formed to investigate into anomalies during the CA elections. 2. A Political Mechanism is to be found to facilitate the peace process and constitution drafting. 3. A new constitution is to be promulgated within one year. 4. Parties to formulate a new TRC bill at the earliest. The points are too general and it l ...

Dear Friends, EX CJP Cheap Chaudhry was judge, jury, and executioner. Wont to issuing Islamic and anticorruption bromides and playing to the press gallery, he was a wrecking ball who meticulously demolished his perceived enemies—in spite of the law. One hopes and prays that the new Chief Justice does believe in non partisan due process and dispassionate rule of law indifferent to outcome. A further weak hope is that senior judiciary will persuade government to reform trial courts. This country is crying for universal, affordable, uncomplicated and speedy resolution of conflicts, we are desperate for rule of law for a semblance of justice. Without it we will have no peace and no progress. A very thought provoking article in the Newsweek. Kindly give your comments please. Reform Philippines Movement (RPM) The CONTRA Statement (Issued in 1997) Reference: GREPOR BUTCH BELGICA CONTRA -- Constitutional Reform Agenda. We opt for a Constitutional Convention (ConCon)! The acronym can also mean-- A counter-offensive to the ill-motivated agenda by the Congress Conspirators to convene into a Constituent Assembly (Con *** . Rationale: The Philippine Republic since her inception in 1898 has not had an honest-to-goodness Constitution written by true, real and grassroots representatives of the people, under a free and independent atmosphere. The first, the Malolos Constitution, never saw political light. Nip in the bud, the document was written by handpicked Deputados covering mostly the illustrious families of Luzon and a few from the Visayas. The second, the 1935 Constitution was ramped into the throat of the Filipino people by their American colonizers. And the third, the Marcos Constitution, was ...

Where are president's photographs? RAJENDRA BAJGAIN Approximately three years back our country metamorphosed into a Democratic Republican state. The whole process was unexpectedly smooth and bloodless in comparison to the similar transformation that has been witnessed in other parts of the globe. People danced and sang on the street with joy as *** were set off in different parts of the country. As Nepal became the newest republic, the photographs of the previous king were removed from all offices and important places across the country. The next logical step would have been, following the election of the first president of the country, Dr Ram Baran Yadav, to have his photograph in government offices and major public places. But that hasn´t happened yet. Have we ever pondered why the photographs of our right honorable president are not visible in key places which once had pictures of the royal family? I have posed this question before scores of people from different walks of life and each of them sa ...

KATHMANDU, DEC 17 - The Election Commission (EC) on Monday once again extended by a week the deadline for the parties to submit the final list of their candidates under the proportional representation (PR) system. The extension, which sets December 25 as the new deadline, was in response to a request from the High-level Political Committee (HLPC), which agreed to seek one more week to prepare their own lists of candidates to be awarded the PR seats. By the extended deadline, the major political parties also hope to reach consensus on addressing the UCPN (Maoist) demands, which would prompt the third largest party to submit the names of its candidates and join the new Constituent Assembly. The party has refused to submit its final PR list demanding an independent probe into the alleged poll-rigging and revival of consensus politics. Cross-party leaders had met Chief Election Commissioner Neel Kantha Uprety to request another extension to the deadline that was set to expire on Wednesday. The EC had earlier ...
Monarchy with Hindu+Buddha nation is the Solution of Nepal Whether or not the constitution will be drafted through the II Constituent Assembly (CA) is entirely a different matter. However on 28 May, 2007, without the consent of people’s vote the political leaders declared republic. On 18 May, 2006 secularism was declared and some days’ later ethnic federalism. These were carried out with active participation by Indian and American intelligence agencies. The Maoists were once known as a nationalist rebel force. Now the Maoists’ leaders, Prachanda and Baburam Bhattarai, have lost the party ideology and they are supporting the anti-Nepal agendas-ethnic-based federalism, secularism and republic. Nepalese people never support these evil elements supporting the suicidal agendas to break Nepal. It is self understood that federalism and racism, secularism and republic are neither issues nor solutions of Nepal. Who lives if the country's identity dies and who dies if the country's identity lives? Prachanda a ...
