They said that the penalty imposed on those who do not buy health insurance under the individual mandate can be fined, because it is a TAX. It added that it was not saying whether the law was a good or bad law. That is the Legislative branch to determine as representative of the people. Obama on many occasions has state it sloppily that the Supreme Court upheld Obamacare. Again, they only agreed that a tax can be set by the Federal government, not that the provision in the law were good or bad. In many ways, these cases are as important as this election. I have a feeling Chief Justice Roberts and Justice Kennedy will be the deciding votes in many of them. I see Roberts siding against racial preferences but also against DOMA. Kennedy could do the same, but he may favor affirmative action. Or may not. Personally I think economic-based affirmative action is better method, but I still see value in racial preferences - but only as a part of a more inclusive list of criteria.
