Calcutta High Court

The Calcutta High Court is the oldest High Court in India. It was established as the High Court of Judicature at Fort William on 1 July 1862 under the High Courts Act, 1861. It has jurisdiction over the state of West Bengal and the Union Territory of the Andaman and Nicobar Islands.

The Supreme Court held that a woman employee of central government can get uninterrupted leave for two years for child care, which also includes needs like examination and sickness. A bench of justices SJ Mukhopadhaya and V Gopala Gowda set aside the order of Calcutta High Court which had held that Central Civil Services (Leave) Rules do not permit uninterrupted CCL(Child Care Leave) for 730 days. "On perusal of circulars and Rule 43-C, it is apparent that a woman government employee having minor children below 18 years can avail CCL for maximum period of 730 days i.e. during the entire service period for taking care of upto two children. The care of children is not for rearing the smaller child but also to look after any of their needs like examination, sickness etc," the bench said. It said that CCL even beyond 730 days can be granted by combining other leave if due and the finding of the High Court was based neither on Rule 43-C nor on guidelines issued by the central government. Physically disabled people demand better treatment KOLKATA: The Sruti Disability Rights Centre and Human Rights Law Network (Kolkata Unit) are contemplating contempt proceedings against the West Bengal government for not complying with Calcutta high court directions in regard to facilities for physically challenged people. In June this year, the high court after hearing a Public Interest Litigation (PIL) on the subject, had directed the state government to ensure that disabled people aren't harassed, reservation of two seats for the blind, orthopedically or congenially handicapped in stage carriage vehicles, including private and mini buses and better facilities for disabled people on roads. Datta refuses to call idol immersion a ‘ritual’. In his application, the activist claimed that the ‘ritual part of immersion’ is completed at the place of worship itself. According to him, immersion processions and the ‘throwing’ of idols into rivers have now become superfluous, gorgeous, colourful, competitive and polluting, which aren’t backed by religious necessity. Datta’s application was backed by an Allahabad high court order that banned immersions in Ganga and Yamuna rivers from 2014. Calcutta High Court in India today directed the state government of West Bengal to hold a three-phase Panchayat (local government) poll and complete the entire process by July 15. The Division Bench of Justice Arun Mishra, Chief Justice, and Justice Joymalya Bagchi also dismissed the State Election Commission (SEC)'s plea for deployment of Central forces for overseeing the poll and held that the state government was free to meet any shortfall either with forces from neigbouring states or Central forces. The state government was directed to announce the poll schedule in consultation with the SEC in three days. Chief minister Mamata Banerjee, currently in north Bengal, welcomed the court’s decision and said the Panchayat polls will be held soon.
