Editorial: U.S. Attorney Preet Bharara nails the Assembly speaker dead to rights, and it’s about time.
Today's arrest of Sheldon Silver is the latest reminder of the need for term limits in Albany. Ensuring that our elected officials uphold the people's trust is one of our most critical responsibilities. Public service must not be a shortcut to self-enrichment. I commend U.S. Attorney Preet Bharara and his team on their dedication to aggressively prosecuting alleged corruption at every level. It's a sad day when criminal charges are brought against any elected official.
The charges against Assembly Speaker Sheldon Silver are staggering. U.S. Attorney Preet Bharara says Silver amassed a $4 million personal fortune by monetizing his office, and did so quietly and cleverly. The feds have seized $3.8 million from eight Silver bank accounts in six different banks. Bharara says the Moreland Commission was investigating but was shut down before it came out. He says no one is above the law, and stay tuned.

FBI: BlackShades infected half-million computers More than a half-million computers in over 100 countries were infected by sophisticated malware that lets cybercriminals remotely hijack a computer and its webcam, authorities said as charges were announced Monday against nearly 100 people worldwide. Authorities said 97 people suspected of using or distributing the malicious software called BlackShades have been arrested in 16 countries, including the software's owner, a 24-year-old Swedish man. "This case is a strong reminder that no one is safe while using the Internet," said Koen Hermans, a Netherlands official in Eurojust, the European Union's criminal investigation coordination unit. "It should serve as a warning and deterrent to those involved in the manufacture and use of this software." U.S. Attorney Preet Bharara called BlackShades a "frightening form of cybercrime," saying a cybercriminal could buy a $40 malicious program whose capabilities were "sophisticated and its invasiveness breathtaking." Users Beware : It is nicknamed "creepware," and more than half a million people around the world have been prey to its silent computer snooping. Miss Teen USA Cassidy Wolf was one of them in a well-publicized case of hacking associated with the malware called Blackshades. Now, an international crackdown by the FBI and police in 19 countries has brought more than 90 arrests in what authorities say is a serious strike against a widespread and growing problem. U.S. Attorney Preet Bharara in New York told reporters the global investigation "exposed and crippled a frightening form of cybercrime that has affected hundreds of thousands of users around the world." The sweep, capping a two-year operation, was coordinated so suspects didn't have time to destroy evidence. It included the arrest of a Swedish hacker who was a co-creator of Blackshades, Alex Yucel, who was apprehended in Moldova. In total, one of the largest global cybercrime crackdowns has yielded the arrests of more than 90 people linked to the Black ...

U.S. Attorney Preet Bharara has a perfect track record of 79-0 in insider trading convictions since the government's crack down began in 2009.
Rajaratnam's brother seeks dismissal of insider trading charges New York (Reuters) - Rengan Rajaratnam, the younger brother of imprisoned hedge fund manager Raj Rajaratnam, urged a U.S. judge on Friday to dismiss insider trading charges leveled against him last year. In a motion filed in U.S. District Court in New York, his lawyers argued the government had taken positions in the indictment that contradicted positions prosecutors took in trying his older brother for insider trading. "Principles of fairness dictate that Rengan, at a minimum, should be tried under the same standard as Raj," the defense lawyers wrote in the motion. A spokeswoman for U.S. Attorney Preet Bharara in Manhattan declined to comment. The case is one of a wave of insider trading prosecutions pursued by Bharara's office, resulting in 79 convictions since October 2009. Raj Rajaratnam, the founder of the hedge fund Galleon Group, received an 11-year prison sentence in October 2011 after a jury convicted him charges related to insider t ...
Two dozen charged in $500 mln New York pain-pill scheme Twenty-five people, including doctors, were charged with involvement in a massive scheme that flooded New York City's black market with as much as $500 million in painkillers, federal and state officials said on Wednesday. The operation was based at a clinic operating under the name Astramed in the city's Bronx borough, said officials, who described it as a "pill mill." The clinic sold phony prescriptions to drug dealers, who bought 5.5 million oxycodone pills at pharmacies around the city and as far away as Florida, the officials said. "This is poison by prescription, and the volume and money allegedly involved would make hardened illegal drug traffickers envious," said Manhattan U.S. Attorney Preet Bharara. Astramed's owner, Dr. Kevin Lowe, collected nearly $12 million in exchange for fake doctor's visits made by phony patients sent in by drug dealers for three years between January 2011 and January 2014, officials said. Twenty-four of the defendan ...
Preet Bharara strikes again; another Indian-American found guilty of insider trading: Manhattan's Indian-American US Attorney Preet Bharara has struck again with the conviction of an Indian-American portfolio manager, giving him an enviable 79-0 record in his four-year long crackdown on insider-trading on Wall Street. A jury of seven women and five men Thursday found former SAC Capital Advisor portfolio manager Mathew Martoma, 39, guilty on one count of conspiracy and two counts of securities fraud. Martoma could end up with a 15-year sentence, given that he was involved in what the prosecutors said was the most lucrative insider-trading crime ever in the US. Martoma's illegal tips earned SAC $275 million in profits and avoided losses from inside information on trials of an experimental Alzheimer's drug developed by Elan and Wyeth. He got the tips from Dr. Sidney Gilman, who served as the government's star witness. "Martoma bought the answer sheet before the exam - more than once - netting a quarter billi ...
India-US ties face new test over Devyani's legal war WASHINGTON: Any expectation that New Delhi and Washington would tide over and quickly heal from the so-called Khobragade episode involving immunity relating to an Indian diplomat's alleged criminal infractions are being laid to rest. The two sides are in for a long, ugly, bruising battle, some of it already being played out in a New York courtroom. The State Department last week legally backed the insistence of its law-enforcement brigade that Devyani Khobragade did not enjoy diplomatic immunity at the time of her arrest, and therefore US authorities were not wrong in arresting and detaining her. More to the point, Washington's legal interpretation gave a green light to US Attorney Preet Bharara to continue pursuing the case, with the observation that Khobragade does not presently enjoy immunity from prosecution for the crimes charged in the indictment. ''The Department of State concludes that Devyani did not enjoy immunity from arrest or detention at t ...
Top Bitcoin executives charged with money laundering New York: Two Bitcoin executives have been charged in the US with conspiring to commit money laundering by selling more than $1 million of the digital currency to users of an illicit online drugs bazaar 'Silk Road'. India-born US Attorney Preet Bharara brought the criminal charges in Manhattan federal court against underground Bitcoin exchanger Robert Faiella, 52, and chief executive officer and compliance officer of a Bitcoin exchange company Charlie Shrem, 24. The two have been charged with conspiring to commit money laundering, and operating an unlicensed money transmitting business. "As alleged, Robert Faiella and Charlie Shrem schemed to sell over $1 million in Bitcoins to criminals bent on trafficking narcotics on the dark web drug site, Silk Road," Bharara said. "Truly innovative business models don't need to resort to old-fashioned law-breaking, and when Bitcoins, like any traditional currency, are laundered and used to fuel criminal activity, l ...
This could have been done before without the needless overzealousness of the District Attorney. Devyani Khobragade was today indicted for visa fraud and making false statements but can leave the US as she has been accorded diplomatic immunity. The charges against 39-year-old Khobragade will remain and she will have to face trial, if she returns to the US without diplomatic immunity, US Attorney Preet Bharara said in a letter to District Judge Shira Scheindlin.
US Attorney Says Immigrant Detainee Data Cannot Be Produced Quickly Federal prosecutors say they can't meet a judge's demands that they quickly deliver documents about thousands of immigrants who've been detained nationwide for months or years as their immigration statuses are reviewed. The office of U.S. Attorney Preet Bharara laid out the government's position to U.S. District Judge Richard M. Berman in a letter made public Wednesday. The letter, dated Tuesday, came five days after the judge criticized the government, saying it had been on notice since the American Civil Liberties Union requested the documents nearly five years ago. The ACLU eventually filed a Freedom of Information Act lawsuit in Manhattan federal court in 2011 seeking documents from the U.S. Department of Homeland Security and U.S. Immigration and Customs Enforcement. The ACLU questioned the practice of "prolonged immigration detention - for months, if not years - without adequate procedures in place to determine whether their detenti ...
(CNN) -- The prosecutor in the U.S. government's case against an Indian diplomat charged in New York with visa fraud related to her treatment of her housekeeper expressed dismay Wednesday over the direction the case has taken. "There has been much misinformation and factual inaccuracy in the reporting on the charges against Devyani Khobragade," said U.S. Attorney Preet Bharara about India's 39-year-old deputy consul general for political, economic, commercial and women's affairs, who was arrested December 12 in New York by federal agents. "It is important to correct these inaccuracies because they are misleading people and creating an inflammatory atmosphere on an unfounded basis." He was referring to reporting about Khobragade's arrest outside her daughter's school, her detention in a cell with other women and her having been subjected to a strip search -- all of which raised diplomatic hackles in New Delhi. Prime Minister Manmohan Singh called the diplomat's treatment "deplorable;" Indian National Secur ...

Devyani Khobragade arrest: Diplomatic row deepens as US refuses to drop charges: India and US seemed to be back to square one in probably their worst diplomatic spat over the arrest of an Indian diplomat with Washington rejecting a key demand to drop the charges against her and saying ‘we take law enforcement seriously’. Activists hold placards during a protest outside the US Consulate in the city after the US said they would not drop charges against diplomat Devyani Khobragade. Pic/AFP Even as it described the relationship with India as ‘incredibly important’ the US on Thursday made clear that it has no plans to drop the charges of visa fraud against Devyani Khobragade, India’s deputy consul general in New York, to deescalate the situation. Any suggestion that the State Department would be putting pressure on New York’s US Attorney Preet Bharara to drop the charges is not true, State Department spokesperson Marie Harf told reporters when asked about such a possibility. It was not for the Stat ...

A lawyer !! I'm shocked !! New York -- New York (AP) — A Chicago lawyer and certified public accountant was convicted Friday for his role in a 10-year tax fraud that generated $7 billion in phony tax losses, a scheme authorities have called the largest tax fraud in history. Paul Daugerdas, the 63-year-old former head of the Chicago office of the now defunct Texas-based law firm Jenkens & Gilchrist, was found guilty of conspiring to defraud the Internal Revenue Service, evade taxes, commit mail and wire fraud and other crimes after a seven-week jury trial in federal court in Manhattan, U.S. Attorney Preet Bharara said. Daugerdas, of Wilmette, Ill., faces up to 58 years in prison when sentenced next March. His lawyer didn't return messages seeking comment. A co-defendant at trial was acquitted of all charges. The tax shelters, prosecutors said, were marketed from 1994 through 2004 to the wealthy and well-connected, including the late sports entrepreneur Lamar Hunt, trust fund recipients, investors, a gran ...

Manhattan U.S. Attorney Preet Bharara says U.S. has time to bring insider trading cases |
U.S. prosecutors are considering charging Steven A. Cohen's SAC Capital Advisors as a criminal enterprise engaged in a long pattern of insider trading in stocks, according to a person familiar with the matter. Prosecutors may use the Racketeer Influenced and Corrupt Organizations Act, most commonly associated with prosecutions against the mafia, to move against Cohen's $15 billion hedge fund company, said the person, who spoke on condition of anonymity. While this is one option under consideration, no final decision has been made, the source added. Indeed, the approach carries its own set of risks and would require approval from top Department of Justice officials, legal experts said. A spokeswoman for Manhattan U.S. Attorney Preet Bharara declined to comment, as did a spokesman for the Justice Department. SAC Capital has previously denied any wrongdoing and a spokesman for the $15 billion firm declined to comment on the potential use of RICO against it. Federal prosecutors have used the 40-year-old RICO ...

Feds: 1 guilty plea, 2 others arrested over virus that infected more than 1M computers Text Size PrintE-mailReprintsBy Associated Press, Jan 23, 2013 10:56 PM EST AP Published: January 23 New York — A computer virus that spread to more than a million computers worldwide, including some at NASA, and produced at least $50 million in illegal profits or losses to victims should be a “wake-up call” for banks and consumers unaware of the threat posed by Internet criminals, a prosecutor said Wednesday. U.S. Attorney Preet Bharara and George Venizelos, head of the New York FBI office, warned of the growing threat to financial and international security as they announced that a 2½-year probe had resulted in three arrests, two of them overseas, and the seizure of vast amounts of computer-related evidence that will take months or years to fully analyze. They said the Gozi virus had infected 40,000 computers in the United States since 2005, including 190 at the National Aeronautics and Space Administration, al ...

But if this is the biggest arrest we're going to get out of the financial crisis, this is laughably weak. Snagging somebody like Serageldin or one of his traders is like arresting one of hundreds of looters during a blackout and not bothering to figure out how the blackout happened in the first place. Serageldin and two of his traders are accused of not properly marking down the value of collateralized debt obligations stuffed with mortgages as the value of those mortgages fell in late 2007.
