In a decision released Friday, U.S. District Judge Lucy Koh in San Jose, California said the five software engineers who brought the case had yet to show that the proposed class plaintiffs had enough in common to allow them to sue together. However, in light of new evidence, she said the nature of the "alleged overarching conspiracy" and desire to litigate it all at once weighed "heavily" in favor of class certification. As a result, she gave the plaintiffs a chance to seek class certification again. The case has been closely watched in Silicon Valley, and much of it has been built on emails among .. ...

![]() San Francisco (Reuters) - Tim Cook is no Steve Jobs when it comes to leading Apple Inc. As the debut of the new iPhone 5 just proved, that may not be a bad thing. The taller, thinner and lighter phone prompted a rush on Wall Street to raise price targets for Apple stock, but the optimism was not because of a big technological advance or design breakthrough; the "wow" factor that was the trademark of the late Apple co-founder Jobs was decidedly absent. Rather, it was the speed of the global launch that astounded, validating the new CEO's much-touted wizardry at the essential but unglamorous task of managing a supply chain. "We are positively surprised regarding the pace of the rollout, since we had expected a bigger impact from component constraints," Barclays analyst Ben Reitzes said. By next Friday, the iPhone 5 will be in 31 countries, and will be in 100 by the end of the calendar year. That would be 30 more than the rollout of the predecessor phone, the 4S, over a similar period, Jeffries analyst Peter ...

US District Court Judge Lucy Koh on Friday lowered the damages awarded to Apple Inc. by $450.5 million for 14 Samsung products including some products in its hot-selling Galaxy lineup, saying jurors had not properly followed her instruction in calculating some of the damages. She also concluded that mistakes had been made in determining when Apple had first notified Samsung about the alleged violations of patents for its trend-setting iPhone and IPad. Multiple news sources have tried to figure out the details of his role, but Hansen isn’t saying much beyond that his plan is to give seminars and advice. An Apple spokeswoman declined to comment. While many large companies conduct internal training programs and house corporate universities, Apple University is particularly interesting because no one is really sure what goes on there. Apple is the only company that makes iPhones, giving it extremely tight control over how the software and hardware work together. On the other hand, Google offers its Android software to many phone makers (Samsung, HTC, LG, and Motorola, among others, offer Android phones). As a result, Android phones vary quite a bit in size, weight, features, user experience, and quality. It’s not uncommon to hear that some Android phones regularly overheat or freeze up or that some models are simply low quality. This inconsistency of quality isn’t an issue for the iPhone. Apple offers users a single choice: what model of iPhone do you want (5, 4S or 4), not what company’s phone and then what model. Of course, some people may prefer the greater choice Android offers. Others, though, will appreciate the simplicity and quality offered by the iPhone. ...

Currently - Apple's soar movement is due to the relocation of manufacturing to some parts from Taiwan to USA. This increased their expenses in wages thus lowering their bottom line dollar. It creates job opportunities for america, but also increased the cost of doing business for Apple. Another big move on Apple was to stop manufacturing some parts to old components (old phones). This is a textbook move to get consumers to buy the new products at a higher price then to fix their current component through some vendor that Apple does not profit. This will put Apple's profits back on the board. -FMC

![]() NEWS ; Apple Inc has started testing a new iPhone and the next version of its iOS software, news website The Next Web reported. Application developers have found in their app usage logs references to a new iPhone identifier, iPhone 6.1, running iOS 7 operating system, the website reported. (iPhone 5 bears the identifiers "iPhone 5.1" and "iPhone 5.2" and is powered by iOS 6 operating system. Developer logs show that the app requests originate from an internet address on Apple's Cupertino campus, suggesting that Apple engineers are testing compatibility for some of the popular apps, the website said. "Although OS and device data can be faked, the unique IP footprint leading back to Apple's Cupertino campus leads us to believe this is not one of those attempts," the website said. Apple launched iPhone 5 in September and it has been reported that the new iPhone will be released in the middle of 2013.

![]() BERKELEY, Calif. (MarketWatch) — Chief Executive Tim Cook has said that Apple Inc. will move some of its offshore manufacturing back into the U.S. This is good news for the local economies and will give Apple better control over its own products. Some people think this is a bad idea for many reasons, not the least of which is a condemnation of the American workforce. Yes, it’s true. Americans, who by all accounts are the most productive in the world, still would actually like to be paid actual money for their labor and effort. It’s beyond me why anyone would work 40-60 hours a week and not do it for free or for $25. But it is a fact that Apple (US:AAPL) has to deal with now. On a visit to China around 1997 I was at a keyboard manufacturing plant where the weekly pay was exactly $25 (I have to assume that by now it has gone up to $26) and I learned a few things. First, I was not going to be shown any sort of sweat shop of the sort I saw years earlier in Hong Kong before the PRC took over the place an ...

![]() How about those Apples? Foxconn Mulls Detroit, Los Angeles for Factory Site November 9, 2012 @ 6:47 am Source: courtesy of Apple Sina News reports that Foxconn, which makes components for Apple Inc. (NASDAQ: AAPL) products among others, may open a factory in the United States. Among the sites being evaluated are Detroit and Los Angeles. Since labor is so cheap in China, it is hard to see why Foxconn would make such a decision and hurt its margins. One reason may be political. Foxconn’s labor abuses have been in the news almost every week. Apple probably is concerned about the reaction of American consumers, and whether these reactions eventually will hurt sales. A factory in America, particularly in a place as badly damaged by the drop in manufacturing jobs as Detroit, would help Foxconn’s image, even if there is a financial cost.
