Breaking from Newsmax.com PRESIDENT BARACK OBAMA IS LIKELY TO PUT GREATER IMPRINT ON THE SUPREME COURT OF US . Barack Obama, already the first president to appoint two female justices, may have a chance to name a third during his second term in office and deepen his imprint on the U.S. Supreme Court. With four justices 74 or older, actuarial tables alone suggest Obama will have another vacancy or two to fill before he leaves the White House in January 2017. The oldest of the court’s nine members, 79-year-old Ruth Bader Ginsburg, has indicated she might retire in the next few years. Names of possible successors are already circulating in Democratic circles. California Attorney General Kamala Harris, Sen. Amy Klobuchar of Minnesota, Assistant U.S. Attorney General Virginia Seitz, and Illinois Attorney General Lisa Madigan are high on the lists. Obama almost certainly would choose a woman to succeed Ginsburg, ensuring the court continues to have three female justices, said Amy Howe, a lawyer at Goldstein & ...

Howard M. Wasserman is a Professor of Law at FIU College of Law. At next week’s oral argument in Kloeckner v. Solis , the Court will consider which Article III court – the U.S. Court of Appeals for the Federal Circuit or a district court, with an appeal to a regional circuit – has jurisdiction to review certain decisions by the Merit Systems Protection Board (“MSPB”), the administrative body primarily responsible for reviewing adverse employment actions against federal employees by federal agencies. The answer will require the Court to parse a complex array of jurisdictional statutes. Kloeckner is the first complicated procedural case of the new Term, about which this site’s Amy Howe (channeling Justice Elena Kagan) might say, “if you understand anything I say, you have a law degree AND you had your cup of coffee.” Indeed, the statutory and factual backgrounds are sufficiently complex, and the procedural background sufficiently central to the case, to warrant extended discussion. Statuto ...
The Supreme Court has upheld the individual mandate of Obamacare. The Court does not deal with any severability issues since they have upheld the individual mandate. While mainstream media first reported that the mandate was struck down, it was SCOTUS blog that called it first. Furthermore, Amy Howe at SCOTUS blog said, “The money quote from the section on the mandate: Our precedent demonstrates that Congress had the power to impose the exaction in Section 5000A under the taxing power, and that Section 5000A need not be read to do more than impose a tax. This is sufficient to sustain it.” “On the Medicaid issue, a majority of the Court holds that the Medicaid expansion is constitutional but that it w/b unconstitutional for the federal government to withhold Medicaid funds for non-compliance with the expansion provisions,” Howe wrote. So apparently the only effect of not complying with the mandate is that you pay the tax. While the Court says that the mandate violates the Constitution under the Com ...

From Amy Howe, today's ACA ruling, briefly and in plain English:
"Amy Howe: The Court holds that the mandate violates the Commerce Clause." Long term, that could be more important than anything else.
Amy Howe: The court reinforces that individuals can simply refuse to pay the tax and not comply with the mandate. via
